Now It\u2019s Coming for Protests"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">A right-wing think<\/span> tank responsible for the emergence of zero-tolerance policing in 1990s New York City and the Trump administration\u2019s <a href=\"https:\/\/www.newyorker.com\/news\/the-lede\/the-war-on-diversity-equity-and-inclusion\" class=\"text link\">scorched-earth campaign<\/a> against <a href=\"https:\/\/www.wired.com\/story\/department-of-labor-tells-employees-to-report-anyone-prioritizing-dei\/\" class=\"text link\">\u201cdiversity, equality and inclusion\u201d programs<\/a> is behind state-level legislative efforts to classify minor protest-related crimes as \u201ccivil terrorism.\u201d<\/p>\n<p class=\"paywall\">The Manhattan Institute, cofounded in 1978 by former Central Intelligence Agency director William Casey, is in the midst of a yearlong campaign to pass state-level legislation reclassifying minor crimes like vandalism, blocking a roadway, or trespassing during a protest as felonies that would carry 18-month prison sentences as punishment.<\/p>\n<p class=\"paywall\">The Manhattan Institute\u2019s push to criminalize forms of nonviolent disobedience as a form of terrorism comes amid a broader Trump administration effort to crack down on <a data-offer-url=\"https:\/\/thebaffler.com\/latest\/phantom-threat-gais\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/thebaffler.com\/latest\/phantom-threat-gais&quot;}\" href=\"https:\/\/thebaffler.com\/latest\/phantom-threat-gais\" rel=\"nofollow noopener\" target=\"_blank\">leftist organizations<\/a>, causes, and social movements, while recasting acts of nonviolent civil disobedience as potential crimes.<\/p>\n<p class=\"paywall\">\u201cToday\u2019s left-wing agitators deploy random acts of lawlessness designed to inconvenience and disrupt as many civilians as possible, hoping to pressure them to get the government to change course. This tactic is reasonably described as a form of terrorism, though the activists aren\u2019t murderous like al-Qaida or Hamas\u2014they don\u2019t use guns, bombs, or threats of unpredictable bloodshed. Instead, they engage in <em>civil terrorism<\/em>,\u201d <a data-offer-url=\"https:\/\/www.city-journal.org\/person\/tal-fortgang\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.city-journal.org\/person\/tal-fortgang&quot;}\" href=\"https:\/\/www.city-journal.org\/person\/tal-fortgang\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a> Manhattan Institute legal policy fellow Tal Fortgang, a recent New York University law graduate who <a data-offer-url=\"https:\/\/www.thefp.com\/p\/to-the-antisemites-who-sit-next-to\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.thefp.com\/p\/to-the-antisemites-who-sit-next-to&quot;}\" href=\"https:\/\/www.thefp.com\/p\/to-the-antisemites-who-sit-next-to\" rel=\"nofollow noopener\" target=\"_blank\">lambasted<\/a> students protesting against Israel\u2019s <a href=\"https:\/\/www.wired.com\/story\/gaza-war-al-shifa-hospital-ghosts\/\" class=\"text link\">war on Gaza<\/a> for \u201cJew hatred.\u201d<\/p>\n<p class=\"paywall\">Fortgang, who\u2019s spent his career at right-wing think tanks, appears to be the main proponent of the \u201ccivil terrorism\u201d theory, beginning with a February 2025 Wall Street Journal op-ed that argued acts of nonviolent disobedience like blocking a road was something far more sinister. More recently, he authored a <a data-offer-url=\"https:\/\/www.city-journal.org\/article\/pro-iran-protests-answer-coalition-foreign-funding\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.city-journal.org\/article\/pro-iran-protests-answer-coalition-foreign-funding&quot;}\" href=\"https:\/\/www.city-journal.org\/article\/pro-iran-protests-answer-coalition-foreign-funding\" rel=\"nofollow noopener\" target=\"_blank\">piece<\/a> in City Journal, the Manhattan Institute\u2019s in-house magazine, targeting the Answer anti-war protest network\u2019s \u201ccentral role in organizing an act of civil terrorism and its advocacy on behalf of Venezuela, Iran, and China [which] are reason enough to believe that its actions may be unlawful under statutes like FARA,\u201d the Foreign Agents Registration Act.<\/p>\n<p class=\"paywall\">In response to WIRED\u2019s questions, Fortgang claims that he focuses on anti-war, pro-Palestinian, and Black Lives Matter activists in his writings justifying the novel \u201ccivil terrorism\u201d theory \u201cbecause they constitute the overwhelming majority of groups engaged in this behavior.\u201d Asked why states should step up protest-related crimes from misdemeanors to felonies, he wrote: \u201cWhen hundreds of people gather to commit disorderly conduct together, we are dealing with something completely different. That is what I call civil terrorism: mass commission of minor crimes to intimidate or coerce a population into adopting certain policies.\u201d<\/p>\n<p class=\"paywall\">Two pieces of state-level legislation ghostwritten by the billionaire-backed Manhattan Institute take steps to see Fortgang\u2019s vision come true. Utah\u2019s legislature passed <a data-offer-url=\"https:\/\/le.utah.gov\/~2026\/bills\/static\/HB0331.html\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/le.utah.gov\/~2026\/bills\/static\/HB0331.html&quot;}\" href=\"https:\/\/le.utah.gov\/~2026\/bills\/static\/HB0331.html\" rel=\"nofollow noopener\" target=\"_blank\">HB 331<\/a> earlier this year, and Governor Spencer Cox signed it into law on March 24. Scant resistance was offered in the Utah House of Representatives and Senate, with only two members voting no during HB 331\u2019s entire trajectory. In addition to heightening penalties for \u201caggravated disorderly conduct\u201d during protests and creating a new crime for \u201cunlawfully advancing foreign organizations,\u201d the Utah law would also outlaw civilians wearing masks at protests, which the Salt Lake Tribune <a data-offer-url=\"https:\/\/www.sltrib.com\/opinion\/editorial\/2026\/03\/01\/tribune-editorial-utahs-move-ban\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.sltrib.com\/opinion\/editorial\/2026\/03\/01\/tribune-editorial-utahs-move-ban\/&quot;}\" href=\"https:\/\/www.sltrib.com\/opinion\/editorial\/2026\/03\/01\/tribune-editorial-utahs-move-ban\/\" rel=\"nofollow noopener\" target=\"_blank\">criticized<\/a> for the open contradiction of local cops and federal immigration agents being allowed to mask up.<\/p>\n<p class=\"paywall\">In Arizona, where the statehouse and governorship are split between Republicans and Democrats, the Manhattan Institute\u2019s <a data-offer-url=\"https:\/\/legiscan.com\/AZ\/votes\/HB2136\/2026\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/legiscan.com\/AZ\/votes\/HB2136\/2026&quot;}\" href=\"https:\/\/legiscan.com\/AZ\/votes\/HB2136\/2026\" rel=\"nofollow noopener\" target=\"_blank\">model legislation<\/a> is currently awaiting a vote in the state Senate, having cleared the Lower Chamber in early March on a 31-21 vote.
