{"id":2709,"date":"2026-06-25T18:36:59","date_gmt":"2026-06-25T18:36:59","guid":{"rendered":"https:\/\/silvybrand.com\/?p=2709"},"modified":"2026-06-25T18:36:59","modified_gmt":"2026-06-25T18:36:59","slug":"a-fatal-tesla-crash-in-texas-sets-up-a-legal-showdown","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=2709","title":{"rendered":"A Fatal Tesla Crash in Texas Sets Up a Legal Showdown"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">On a Texas<\/span> evening last week, a 76-year-old grandmother named Martha Avila was standing in the front room of her suburban home when a <a href=\"https:\/\/www.wired.com\/tag\/tesla\/\" class=\"text link\">Tesla<\/a> Model 3 hurtled into her brick home at a reported speed of over 70 miles per hour, killing her.<\/p>\n<p class=\"paywall\">The car\u2019s driver, 44-year-old Michael Butler, later told police that he had <a href=\"https:\/\/www.wired.com\/story\/story\/tesla-urging-drowsy-drivers-to-use-full-self-driving-that-could-go-very-wrong\/\" class=\"text link\">Tesla\u2019s driver assistance features<\/a>\u2014which the automaker argues make driving safer and less stressful\u2014engaged during the crash. Butler exhibited \u201cno signs of intoxication,\u201d the Harris County Sheriff\u2019s Office, which responded to the crash, noted in a report.<\/p>\n<p class=\"paywall\">Now Avila\u2019s family is suing not only Butler but also Tesla, alleging that the electric-auto maker&#8217;s Full Self-Driving (Supervised) driver assistance feature, also called FSD, played a role in her death. The feature is designed to handle certain aspects of driving\u2014including navigating city and residential roads, stopping for red lights and stop signs, and changing lanes\u2014but it requires drivers to pay attention and stay ready to intervene if the system makes a mistake. The suit alleges Tesla\u2019s tech \u201cwas defective in design and unreasonably dangerous,\u201d lawyers representing Avila\u2019s daughter and son-in-law wrote in a lawsuit filed in Harris County District Court on Tuesday. (The son-in-law, Justin Barbour, was also in the home and injured in the crash.)<\/p>\n<p class=\"paywall\">Tesla didn\u2019t respond to WIRED\u2019s request for comment. But on X, Tesla vice president of AI software Ashok Elluswamy <a data-offer-url=\"https:\/\/x.com\/aelluswamy\/status\/2069168079549161491\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/aelluswamy\/status\/2069168079549161491&quot;}\" href=\"https:\/\/x.com\/aelluswamy\/status\/2069168079549161491\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a> that Tesla data showed that Butler \u201cmanually overrode self-driving by pressing the accelerator all the way to 100 percent\u201d and \u201chad the accelerator pressed even after the crash.\u201d Tesla CEO Elon Musk posted that speculation that the company\u2019s technology played a role in the crash \u201cmakes no sense.\u201d<\/p>\n<p class=\"paywall\">Plenty of the crash\u2019s specifics have yet to come out, and it\u2019s very possible that Tesla\u2019s tech didn\u2019t have anything to do with Avila\u2019s death. But even if the driver is mostly responsible for what happened, the electric-auto maker could still be found at least partially culpable\u2014and liable for big monetary damages.<\/p>\n<p class=\"paywall\">\u201cIf the product is designed in a way that it leaves drivers vulnerable to situations where suddenly the system is not working and they\u2019ve lost situational awareness, Tesla could be found responsible,\u201d says Matthew Wansley, a professor with Yeshiva University\u2019s Cardozo School of Law who studies automotive tech.<\/p>\n<p class=\"paywall\">In fact, it\u2019s happened before. Last year, a Florida jury found that the driver of a Tesla Model S using Autopilot, Tesla\u2019s earlier driver assistance software, <a href=\"https:\/\/www.wired.com\/story\/tesla-liable-2019-autopilot-crash-death\/\" class=\"text link\">was mostly responsible<\/a> for a crash in which he failed to see that the T-shaped intersection his car was traveling on was ending. He kept his foot on the accelerator, and the Tesla collided with and killed 22-year-old Naibel Benavides Leon. Her boyfriend, 26-year-old Dillon Angulo, was seriously injured. (Despite often touting its vehicles\u2019 expansive data collection abilities, Tesla said it couldn\u2019t recover critical data related to the case; Benavides\u2019 family lawyers were later able to recover it <a data-offer-url=\"https:\/\/www.washingtonpost.com\/technology\/2025\/08\/29\/tesla-autopilot-crashes-evidence-testimony-wrongful-death\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.washingtonpost.com\/technology\/2025\/08\/29\/tesla-autopilot-crashes-evidence-testimony-wrongful-death\/&quot;}\" href=\"https:\/\/www.washingtonpost.com\/technology\/2025\/08\/29\/tesla-autopilot-crashes-evidence-testimony-wrongful-death\/\" rel=\"nofollow noopener\" target=\"_blank\">with help from a hacker<\/a>.)<\/p>\n<p class=\"paywall\">But the jury also found, in a precedent-breaking decision, that Tesla shared one-third responsibility for the crash because it believed Autopilot was effective. It determined that Tesla was liable for $200 million in punitive damages, plus an additional $43 million in compensatory damages. A judge upheld the verdict earlier this year.<\/p>\n<p class=\"paywall\">Critics of Tesla\u2019s approach argue that it\u2019s precisely because FSD is pretty great that the feature presents a problem. If drivers trust that the system operates well all the time, they might not be prepared to take over if something goes wrong. In a 2018 California highway crash, the driver behind the wheel of a Model X using Autopilot failed to take over steering before the vehicle crashed into a barrier, killing him.
