Under the 14th Amendment, which was ratified in 1868 to guarantee citizenship and equal protection to the children of formerly enslaved people, anyone born in the United States \u201cand subject to the jurisdiction thereof\u201d is a citizen.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">Trump issued the executive order, titled \u201cProtecting the Meaning and Value of American Citizenship,\u201d just hours after being sworn back into office in early 2025 \u2014 and the administration was almost immediately sued in response. Defending the executive order before the Supreme Court, Solicitor General D. Sauer <a href=\"https:\/\/www.theverge.com\/policy\/905649\/trump-supreme-court-birthright-citizenship-scotus-arguments\">argued<\/a> that noncitizens and their children aren\u2019t \u201csubject to the jurisdiction\u201d of the United States, since their loyalty lies with a foreign power.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">An <a href=\"https:\/\/www.migrationpolicy.org\/news\/birthright-citizenship-repeal-projections\">estimated 250,000 children<\/a> are born on US soil to noncitizen parents each year. The birthright citizenship ban would not have gone into effect retroactively, but would have applied to anyone born 30 days after Trump\u2019s executive order was issued.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">Even conservative justices were skeptical of the administration\u2019s argument. After Sauer claimed that the 14th Amendment needs to be revisited because we live in a different world than that of Reconstruction, Justice Neil Gorsuch countered: \u201cit\u2019s the same Constitution.\u201d Still, the fact that such a fundamental constitutional right was up for debate shows just how much Trump\u2019s nativist vision has affected American politics.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">Gorsuch ultimately caved, not only signing onto Justice Clarence Thomas\u2019s dissenting opinion but also writing one of his own.
