{"id":3457,"date":"2026-07-09T09:57:30","date_gmt":"2026-07-09T09:57:30","guid":{"rendered":"https:\/\/silvybrand.com\/?p=3457"},"modified":"2026-07-09T09:57:30","modified_gmt":"2026-07-09T09:57:30","slug":"federal-investigators-say-certain-doge-records-were-deleted","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=3457","title":{"rendered":"Federal Investigators Say Certain DOGE Records Were Deleted"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">On April 14,<\/span> 2025, a <a href=\"https:\/\/www.wired.com\/story\/he-blew-the-whistle-on-doge-then-his-brakes-were-cut\/\" class=\"text link\">federal IT staffer<\/a> filed a <a data-offer-url=\"https:\/\/whistlebloweraid.org\/wp-content\/uploads\/2025\/04\/2025_0414_Berulis-Disclosure-with-Exhibits.s.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/whistlebloweraid.org\/wp-content\/uploads\/2025\/04\/2025_0414_Berulis-Disclosure-with-Exhibits.s.pdf&quot;}\" href=\"https:\/\/whistlebloweraid.org\/wp-content\/uploads\/2025\/04\/2025_0414_Berulis-Disclosure-with-Exhibits.s.pdf\" rel=\"nofollow noopener\" target=\"_blank\">whistleblower complaint with Congress<\/a> alleging that members of the so-called <a href=\"https:\/\/www.wired.com\/tag\/doge\/\" class=\"text link\">Department of Government Efficiency (DOGE)<\/a> had accessed and possibly exfiltrated sensitive information from the National Labor Relations Board (NLRB).<\/p>\n<p class=\"paywall\">Just days after filing the complaint, Dan Berulis, the whistleblower, found the brakes on his car <a href=\"https:\/\/www.wired.com\/story\/he-blew-the-whistle-on-doge-then-his-brakes-were-cut\/\" class=\"text link\">had been cut<\/a> after getting into a minor accident near his home. The complaint, which <a href=\"https:\/\/www.npr.org\/2025\/04\/15\/nx-s1-5355896\/doge-nlrb-elon-musk-spacex-security\" class=\"text link\">went public<\/a> in an NPR story the day after it was filed, caused an outcry, with <a href=\"https:\/\/laborcaucus.house.gov\/media\/press-releases\/labor-caucus-members-demand-answers-on-doge-access-to-nlrb-information\" class=\"text link\">members of Congress<\/a> <a data-offer-url=\"https:\/\/www.documentcloud.org\/documents\/25898302-house-dem-oversight-letter-doge-nlrb-access\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.documentcloud.org\/documents\/25898302-house-dem-oversight-letter-doge-nlrb-access\/&quot;}\" href=\"https:\/\/www.documentcloud.org\/documents\/25898302-house-dem-oversight-letter-doge-nlrb-access\/\" rel=\"nofollow noopener\" target=\"_blank\">calling for an investigation<\/a>. The following month, in May 2025, <a data-offer-url=\"https:\/\/fedscoop.com\/national-labor-relations-board-watchdog-investigating-doge-potential-data-breach\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/fedscoop.com\/national-labor-relations-board-watchdog-investigating-doge-potential-data-breach\/&quot;}\" href=\"https:\/\/fedscoop.com\/national-labor-relations-board-watchdog-investigating-doge-potential-data-breach\/\" rel=\"nofollow noopener\" target=\"_blank\">FedScoop reported<\/a> that the NLRB\u2019s Office of the Inspector General (OIG) opened an investigation. It remains ongoing.<\/p>\n<p class=\"paywall\">In April 2026, though, the Government Accountability Office (GAO)\u2014a federal agency within the legislative branch that performs audits and investigations for Congress\u2014 <a data-offer-url=\"https:\/\/www.gao.gov\/assets\/gao-26-108774.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.gao.gov\/assets\/gao-26-108774.pdf&quot;}\" href=\"https:\/\/www.gao.gov\/assets\/gao-26-108774.pdf\" rel=\"nofollow noopener\" target=\"_blank\">published its own report<\/a> about DOGE\u2019s access to the NLRB\u2019s systems, titled \u201cNational Labor Relations Board Detailees Did Not Access IT Systems Between April 16 and July 25, 2025.\u201d The report conspicuously only covers the time period immediately following Berulis\u2019 complaint, and does not address any DOGE activity before that point.<\/p>\n<p class=\"paywall\">But nested in the footnotes of the report is another revelation: In August 2025, shortly after DOGE members left the NLRB but before the GAO\u2019s investigators \u201crequested to observe the systems,\u201d the agency \u201cdeleted the team member accounts for system access after the agreement to detail DOGE team staff had expired.\u201d Basically, this means that the digital records of what data and systems DOGE members accessed and when had been eliminated, leaving the GAO no way to confirm what NLRB staff told their investigators.<\/p>\n<p class=\"paywall\">\u201cI think you could imagine another situation where the footnote is the central theme of the report,\u201d says Don Moynihan, a professor of public policy at the University of Michigan. \u201cThe report raises more questions than it resolves, such as who deleted the data.\u201d<\/p>\n<p class=\"paywall\">The NLRB enforces laws concerning unions and collective bargaining, and investigates unfair labor practices. This gives it access to the identities of whistleblowers as well as their testimony; information about trade secrets and other proprietary data that might be important in issues related to negotiations between employers and employees; and a wide variety of investigative materials.<\/p>\n<p class=\"paywall\">According to Berulis\u2019 whistleblower complaint, \u201cDOGE officials required the highest level of access and unrestricted access to internal systems. They were to be given what are referred to as \u2018tenant owner\u2019 level accounts, with essentially unrestricted permission to read, copy, and alter data\u201d\u2014a level of access beyond that of the agency\u2019s chief information officer.<\/p>\n<p class=\"paywall\">In the report, GAO officials note that they \u201cinterviewed NLRB staff regarding what level of access they provided for each system to the DOGE team,\u201d but were unable to confirm whether what they were told was true because the DOGE accounts and associated information had already been deleted from the NLRB\u2019s systems. It\u2019s also not clear exactly who from DOGE had access: Justin Fox, Nate Cavanaugh, and Jordan Wick were all at one point at the NLRB, but no specific DOGE members are named in the report nor in Berulis\u2019 original whistleblower complaint.<\/p>\n<p class=\"paywall\">The NLRB did not respond to a request for comment; neither did Fox, Cavanaugh, or Wick.<\/p>\n<p class=\"paywall\">Tesla and SpaceX, both companies owned by Elon Musk, who also led DOGE, have been the subject of NLRB investigations. Earlier this year, the NLRB <a data-offer-url=\"https:\/\/www.theguardian.com\/technology\/2026\/feb\/11\/nlrb-drops-legal-battle-spacex-elon-musk\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.theguardian.com\/technology\/2026\/feb\/11\/nlrb-drops-legal-battle-spacex-elon-musk&quot;}\" href=\"https:\/\/www.theguardian.com\/technology\/2026\/feb\/11\/nlrb-drops-legal-battle-spacex-elon-musk\" rel=\"nofollow noopener\" target=\"_blank\">dropped the case<\/a> against SpaceX, saying that the agency didn\u2019t have jurisdiction over the company.<\/p>\n<p class=\"paywall\">In an April <a href=\"https:\/\/www.warren.senate.gov\/newsroom\/press-releases\/warren-blumenthal-investigate-whether-political-interference-by-elon-musk-doge-caused-labor-board-decision-to-drop-spacex-charges\/\" class=\"text link\">statement<\/a> announcing an investigation into the case\u2019s dismissal, Democratic senators Elizabeth Warren and Richard Blumenthal wrote: \u201cGiven Musk\u2019s extraordinary financial support for President Trump in the 2024 election, his substantial influence in the Trump Administration and interest in the NLRB\u2019s work as head of [DOGE] \u2026 we seek answers to determine if the decision to drop the case may have been based on political considerations rather than the facts at hand.\u201d<\/p>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.wired.com\/story\/federal-investigators-say-certain-doge-records-were-deleted\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On April 14, 2025, a federal IT staffer filed a whistleblower complaint with Congress alleging that members of the so-called Department of Government Efficiency (DOGE) had accessed and possibly exfiltrated sensitive information from the National Labor Relations Board (NLRB).
