It complained that the proposals to increase pressure on sites to demonstrate efforts to crack down on underage access are unnecessary, ill-suited, unfair, and could violate privacy rights.<\/p>\n<p class=\"paywall\">X pushed back against the \u201chighly invasive\u201d information gathering powers the proposed amendment would allow, accusing the commissioner of having \u201cseemingly no understanding\u201d of how this would work for the platforms and no safeguards for confidential and commercially sensitive information. Demanding data, documents, and compliance evidence from non-Australians in other countries could cause issues \u201cfor the comity of nations,\u201d the firm also warned.<\/p>\n<p class=\"paywall\">Australia is leading a <a href=\"https:\/\/www.wired.com\/story\/uk-social-media-under-16-ban\/\" class=\"text link\">growing global movement<\/a> to restrict children\u2019s access to social media, after banning under-16s from the sites in December. In May, the country ordered X to pay a $463,000 fine for failing to comply with child safety measures. The country\u2019s internet regulator eSafety first issued the fine in 2023, claiming X did not respond sufficiently to a request for information on how it was tackling the spread of child sexual abuse content online, submitted one month before <a href=\"https:\/\/www.wired.com\/tag\/elon-musk\/\" class=\"text link\">Elon Musk<\/a> took over Twitter, now X.<\/p>\n<p class=\"paywall\">X has previously criticized the country\u2019s \u201cexcessive\u201d penalty regime and complained in the most recent submission that a proposal to increase penalties against individuals is \u201centirely unjustified and disproportionate.\u201d<\/p>\n<p class=\"paywall\">Musk has been a particularly vocal critic of Australia\u2019s bill to make 16 years the minimum age for social media. \u201cSeems like a backdoor way to control access to the Internet by all Australians,\u201d <a data-offer-url=\"https:\/\/x.com\/elonmusk\/status\/1859479797329535168\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/elonmusk\/status\/1859479797329535168&quot;}\" href=\"https:\/\/x.com\/elonmusk\/status\/1859479797329535168\" rel=\"nofollow noopener\" target=\"_blank\">he wrote on X<\/a> when the legislation was announced in late 2024. When Spanish prime minister Pedro S\u00e1nchez announced similar measures in February this year, Musk called him a \u201ctyrant\u201d and \u201ctrue fascist totalitarian.\u201d<\/p>\n<p class=\"paywall\">While many digital rights campaigners believe the blanket age bans on social media are \u201cproblematic,\u201d the information-gathering powers are not the issue, says Stefania Di Stefano, a researcher in international law and technologies.<\/p>\n<p class=\"paywall\">\u201cFor me, the complete ban from social media on children and minors is problematic from an international human rights perspective,\u201d says Di Stefano. \u201cIt is disproportionate with respect to the right of children to exercise their right to freedom of expression, their right to access information, their right to association, and so on and so forth.\u201d<\/p>\n<p class=\"paywall\">But Julia H\u00f6rnle, a professor of internet law at Queen Mary University of London, is skeptical about X\u2019s submission. \u201cA regulator in Australia ordering X to disclose a document in relation to their business activities in Australia, that\u2019s perfectly fine,\u201d she tells WIRED. \u201cFrom all the data in the possession of the social media company, they can distinguish between Australian and non-Australian children, and therefore keep regulation to Australia.\u201d<\/p>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.wired.com\/story\/x-says-australias-under-16s-social-media-bans-risk-interfering-with-foreign-law\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>X has a new argument against sweeping underage social media bans which would limit usage of its platform: They interfere with international law.
