{"id":4764,"date":"2026-07-31T16:50:34","date_gmt":"2026-07-31T16:50:34","guid":{"rendered":"https:\/\/silvybrand.com\/?p=4764"},"modified":"2026-07-31T16:50:34","modified_gmt":"2026-07-31T16:50:34","slug":"can-republicans-actually-send-anthony-fauci-to-jail","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=4764","title":{"rendered":"Can Republicans Actually Send Anthony Fauci to Jail?"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">In the immediate<\/span> aftermath of <a href=\"https:\/\/www.wired.com\/story\/anthony-fauci-interview-q-and-a-july-2024-trump-harris\/\" class=\"text link\">Anthony Fauci\u2019s<\/a> tense congressional hearing on Wednesday, where he refused to answer any questions and invoked the Fifth Amendment, <a href=\"https:\/\/www.wired.com\/story\/laura-loomer-ukraine\/\" class=\"text link\">MAGA figures and Republican officials appeared<\/a> to be seeking one thing: jail time for the former <a href=\"https:\/\/www.wired.com\/story\/the-white-house-is-trying-to-figure-out-what-to-do-about-chinese-ai\/\" class=\"text link\">White House<\/a> chief medical adviser.<\/p>\n<p class=\"paywall\">\u201cWhy, when Fauci walks off of there today, is he not cuffed?\u201d Steve Bannon, a former adviser to President Donald Trump, <a data-offer-url=\"https:\/\/x.com\/gc22gc\/status\/2082474072487886947\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/gc22gc\/status\/2082474072487886947&quot;}\" href=\"https:\/\/x.com\/gc22gc\/status\/2082474072487886947\" rel=\"nofollow noopener\" target=\"_blank\">asked on his <em>War Room<\/em> podcast<\/a> on Wednesday. \u201cPeople are furious today to cut on this and see Fauci hiding behind the Fifth Amendment \u2026 He should die in prison.\u201d<\/p>\n<p class=\"paywall\">\u201cWhy isn\u2019t he under arrest?\u201d far-right podcaster Matt Walsh <a data-offer-url=\"https:\/\/x.com\/MattWalshBlog\/status\/2082519063385743403\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/MattWalshBlog\/status\/2082519063385743403&quot;}\" href=\"https:\/\/x.com\/MattWalshBlog\/status\/2082519063385743403\" rel=\"nofollow noopener\" target=\"_blank\">wrote on X<\/a>. \u201cWhy isn\u2019t he facing any real consequences? Why aren\u2019t you actually doing anything?\u201d<\/p>\n<p class=\"paywall\">Fauci appeared before the US Senate committee investigating his handling of the Covid-19 pandemic and invoked his constitutional right to stay silent, known as the Fifth Amendment, over 100 times. In <a href=\"https:\/\/www.youtube.com\/watch?v=YniJOGbfFqI\" class=\"text link\">his opening statement<\/a> explaining his decision, he described Senator Rand Paul, who chaired the hearing, as having an \u201cunhinged obsession\u201d with him.<\/p>\n<p class=\"paywall\">\u201cThe only conclusion I can reach is that the sole reason he is calling me before this committee is to get me to say something, anything, that could vindicate his repeated public pledges that I end up, in his words, \u2018behind bars,\u2019\u201d Fauci said. Paul has long accused Fauci of covering up what could have been the origins of Covid-19.<\/p>\n<p class=\"paywall\">As calls for Fauci\u2019s imprisonment grow louder from far-right influencers and podcasters, WIRED turned to legal experts to assess just how likely it is that Republicans in Congress could jail the former public health official.<\/p>\n<p class=\"paywall\">Last year, Fauci <a href=\"https:\/\/www.justice.gov\/pardon\/media\/1385746\/dl?inline\" class=\"text link\">received a preemptive pardon<\/a> from former President Joe Biden, which covered his actions from 2014 until 2025 and made him immune from prosecution for federal crimes during that period but not for anything that he has said or done subsequently.<\/p>\n<p class=\"paywall\">Republicans like Paul, however, believe that anyone who has received a presidential pardon automatically loses their Fifth Amendment rights, citing a <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/161\/591\/\" class=\"text link\">Supreme Court case from 1896<\/a> as proof. \u201cI think there is a very real chance that he could be prosecuted for that,\u201d Paul told <a data-offer-url=\"https:\/\/www.cbsnews.com\/news\/rand-paul-anthony-fauci-very-real-chance-prosecuted-covid-senate-hearing-5th\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.cbsnews.com\/news\/rand-paul-anthony-fauci-very-real-chance-prosecuted-covid-senate-hearing-5th\/&quot;}\" href=\"https:\/\/www.cbsnews.com\/news\/rand-paul-anthony-fauci-very-real-chance-prosecuted-covid-senate-hearing-5th\/\" rel=\"nofollow noopener\" target=\"_blank\">CBS News<\/a> after the hearing. \u201cA court ultimately would have to determine: Does the Fifth Amendment apply to someone who already has a pardon?\u201d<\/p>\n<p class=\"paywall\">Paul said his committee will hold a vote next week on whether to hold Fauci in contempt of Congress, a <a href=\"https:\/\/www.congress.gov\/crs-product\/LSB10974\" class=\"text link\">charge that carries<\/a> a potential punishment of up to one year in jail and a fine of up to $100,000. If passed, it will be sent to the Senate floor where it would require 60 votes to succeed, which is highly unlikely given it would require Democrats to side with Republicans.<\/p>\n<p class=\"paywall\">In 2020, Trump pardoned numerous people before he left office, including <a href=\"https:\/\/www.wired.com\/story\/nso-group-the-vogel-group-lobbying-trump-administration\/\" class=\"text link\">disgraced former national security adviser Mike Flynn<\/a> and his former campaign chair <a href=\"https:\/\/www.wired.com\/story\/manafort-cohen-guilty-trump-mueller-investigation\/\" class=\"text link\">Paul Manafort<\/a>. At the time, US constitutional scholar Aziz Huq <a data-offer-url=\"https:\/\/www.washingtonpost.com\/outlook\/2020\/12\/22\/trump-pardons-congress-investigations-self\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.washingtonpost.com\/outlook\/2020\/12\/22\/trump-pardons-congress-investigations-self\/&quot;}\" href=\"https:\/\/www.washingtonpost.com\/outlook\/2020\/12\/22\/trump-pardons-congress-investigations-self\/\" rel=\"nofollow noopener\" target=\"_blank\">concluded<\/a> that the pardons opened up the possibility of contempt if those Trump associates refused to testify before Congress about action they took during Trump\u2019s first term in office.<\/p>\n<p class=\"paywall\">Bannon himself was pardoned by Trump in 2021, but only for specific federal charges related to his \u201c<a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/leaders-we-build-wall-online-fundraising-campaign-charged-defrauding-hundreds-thousands\" class=\"text link\">We Build the Wall<\/a>\u201d scheme, whose leaders were charged with defrauding donors out of hundreds of thousands of dollars in the name of a border wall between the US and Mexico.
