Former Flight Attendants Are Freaked Out"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">Spirit Airlines may<\/span> have <a href=\"https:\/\/www.wired.com\/story\/what-the-spirit-airlines-implosion-means-for-your-vacation\/\" class=\"text link\">declared bankruptcy this spring,<\/a> but the budget airline is still worth something\u2014to AI giants, at least. In mid-August, Google won a $10 million bid to purchase some 34 years of the airline\u2019s data, from invoices and flight operations information to Wi-Fi sales, employee records, and crew pairings.<\/p>\n<p class=\"paywall\">In a statement, a Google spokesperson said the data \u201ccan be helpful in improving our products and <a href=\"https:\/\/www.wired.com\/tag\/google-gemini\/\" class=\"text link\">AI models<\/a>.\u201d The sale would not include customer data, and Google \u201cwill not receive any personal information from this dataset,\u201d the spokesperson said. The winning offer, chosen over a competing $7.5 million proposal from AI data and training company Mercor, has to be approved by a judge.<\/p>\n<p class=\"paywall\">If former <a href=\"https:\/\/www.wired.com\/tag\/airlines\/\" class=\"text link\">Spirit Airlines<\/a> attendants have their way, that won\u2019t happen easily. Just days after the court announced Google\u2019s winning bid, the labor union representing 5,500 former Spirit Airlines flight attendants filed an objection to the sale. Lawyers for the 55,000-member Association of Flight Attendants (AFA) argue the sale would include an enormous amount of sensitive employee information, and that even Google\u2019s promised safeguards wouldn\u2019t prevent privacy violations of decades of flight attendants who never could have guessed that their data would be sold to train AI systems.<\/p>\n<p class=\"paywall\">The employee data \u201chas no business being sold,\u201d Sara Nelson, the president of the AFA, said in a written statement to WIRED. \u201cThis is outrageous!\u201d<\/p>\n<p class=\"paywall\">The legal objection opens a potential new front in the <a href=\"https:\/\/www.wired.com\/story\/i-work-in-hollywood-everyone-who-used-to-make-tv-now-training-ai\/\" class=\"text link\">AI data wars<\/a>, as major frontier labs including Google, <a href=\"https:\/\/www.wired.com\/tag\/openai\/\" class=\"text link\">OpenAI<\/a>, <a href=\"https:\/\/www.wired.com\/tag\/anthropic\/\" class=\"text link\">Anthropic<\/a>, and Mercor scramble to find new sources of data to help train their products. US laws have contemplated how best to protect consumer data, even after companies go bankrupt and are sold off for parts\u2014laws that have taken on new salience and value in the age of AI.<\/p>\n<p class=\"paywall\">But the Spirit Airlines\u2019 flight attendants\u2019 legal objection highlights the gap between data protections for consumers and for workers. It also marks the first public tangle between labor unions and corporations over the sale and use of employee data for AI training purposes, legal experts say.<\/p>\n<p class=\"paywall\">\u201cThere is no boundary between the information and data that the employee is producing and their own personal information. The law has not caught up,\u201d says Seema Patel, a law professor at the University of California, College of the Law, San Francisco, who studies labor issues and technology. (California is one of the few states to have explicit worker data protection laws.) &#8220;Companies are having a field day with this.\u201d<\/p>\n<p class=\"paywall\">In the past few months, startups specializing in selling defunct companies\u2019 data\u2014including old Slack messages, <a href=\"https:\/\/www.wired.com\/tag\/github\/\" class=\"text link\">GitHub<\/a> content, and Google Drives\u2014to those training AI have <a data-offer-url=\"https:\/\/www.theinformation.com\/articles\/startups-find-old-slack-threads-tickets-suddenly-high-demand\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.theinformation.com\/articles\/startups-find-old-slack-threads-tickets-suddenly-high-demand&quot;}\" href=\"https:\/\/www.theinformation.com\/articles\/startups-find-old-slack-threads-tickets-suddenly-high-demand\" rel=\"nofollow noopener\" target=\"_blank\">reportedly made millions<\/a>. Meanwhile, so-called <a href=\"https:\/\/www.wired.com\/story\/household-chores-training-robots\/\" class=\"text link\">egocentric data collection<\/a> efforts are on the rise, as companies race to record humans performing work like <a href=\"https:\/\/www.wired.com\/story\/i-let-a-private-chef-film-my-kitchen-for-robot-training-data\/\" class=\"text link\">cooking meals<\/a>, cleaning kitchens, and operating factory lines, and use that data to train machines to aid and eventually replace them.<\/p>\n<p class=\"paywall\">The Spirit data sale would, according to a court filing, include more than 1 million time-card records, over 175,000 employee records, nearly 150,000 employee tax forms, employment contracts and litigation files, 80,000 email accounts, 17 million individually owned Microsoft OneDrive items, 20.6 million shared Microsoft SharePoint files, and 500 million Microsoft Teams records.<\/p>\n<p class=\"paywall\">The court filing describes a process through which the data buyer\u2014Google\u2014would select or OK a third party to strip the data of elements that could be used to link the information with a particular consumer.
