{"id":6152,"date":"2026-08-28T03:13:27","date_gmt":"2026-08-28T03:13:27","guid":{"rendered":"https:\/\/silvybrand.com\/?p=6152"},"modified":"2026-08-28T03:13:27","modified_gmt":"2026-08-28T03:13:27","slug":"a-judge-has-blocked-the-pentagons-attempt-to-blacklist-anthropic","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=6152","title":{"rendered":"A Judge Has Blocked the Pentagon\u2019s Attempt to Blacklist Anthropic"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p>A federal judge on Thursday barred the <a href=\"https:\/\/www.wired.com\/tag\/donald-trump\/\" class=\"text link\">Trump administration<\/a> from designating Anthropic a national security risk over a dispute about the use of its AI models, ruling that the designation amounted to unconstitutional retaliation.<\/p>\n<p class=\"paywall\">The decision handed down by US district judge Rita Lin in California vacated the February 27 decision by defense secretary Pete Hegseth to label Anthropic a <a href=\"https:\/\/www.wired.com\/story\/trump-moves-to-ban-anthropic-from-the-us-government\/\" class=\"text link\">\u201csupply-chain risk\u201d<\/a> and make the company ineligible for federal contracts. The ruling also lifted an additional punitive measure by Hegseth that prevented contractors or suppliers to the US military from doing business with Anthropic, a position Lin called \u201carbitrary, capricious, an abuse of discretion, and otherwise not in accordance with law.\u201d<\/p>\n<p class=\"paywall\">\u201cThough the Department of War is undisputedly free to select the AI vendor of its choice, the evidence demonstrates that the broad measures imposed on Anthropic were illegal and baseless,\u201d Lin wrote in a <a data-offer-url=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.465515\/gov.uscourts.cand.465515.250.0.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.465515\/gov.uscourts.cand.465515.250.0.pdf&quot;}\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.465515\/gov.uscourts.cand.465515.250.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">59-page ruling<\/a>.<\/p>\n<p class=\"paywall\">The judge also ruled that nine agencies\u2014including the Pentagon, the Treasury Department, the State Department, the Department of Homeland Security\u2014had improperly imposed sanctions on Anthropic. The ruling removes those penalties.<\/p>\n<p class=\"paywall\">However, Lin <a data-offer-url=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.465515\/gov.uscourts.cand.465515.251.0.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.465515\/gov.uscourts.cand.465515.251.0.pdf&quot;}\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.465515\/gov.uscourts.cand.465515.251.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">affirmed<\/a> that the Pentagon is not required to use Anthropic\u2019s models, and the ruling does not prevent the Pentagon from electing to simply use other models. A Pentagon spokesperson could not immediately be reached for comment, but the department is expected to appeal.<\/p>\n<p class=\"paywall\">In a statement, Anthropic spokesperson Danielle Cohen said: \u201cWe welcome the court\u2019s ruling that this supply chain risk designation was unlawful. We remain focused on working productively with the government to harness AI for our national security.\u201d<\/p>\n<p class=\"paywall\">The case stems from a bitter dispute earlier this year between the Pentagon and <a href=\"https:\/\/www.wired.com\/tag\/anthropic\/\" class=\"text link\">Anthropic<\/a> over a <a data-offer-url=\"https:\/\/www.anthropic.com\/news\/anthropic-and-the-department-of-defense-to-advance-responsible-ai-in-defense-operations\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.anthropic.com\/news\/anthropic-and-the-department-of-defense-to-advance-responsible-ai-in-defense-operations&quot;}\" href=\"https:\/\/www.anthropic.com\/news\/anthropic-and-the-department-of-defense-to-advance-responsible-ai-in-defense-operations\" rel=\"nofollow noopener\" target=\"_blank\">$200 million deal<\/a> to use the AI lab\u2019s Claude models military applications.<\/p>\n<p class=\"paywall\">The rift began after <a href=\"https:\/\/www.axios.com\/2026\/02\/13\/anthropic-claude-maduro-raid-pentagon\" class=\"text link\">reports<\/a> that the US had used Claude in the operation to capture <a href=\"https:\/\/www.wired.com\/story\/us-invaded-venezuela-and-captured-nicolas-maduro-chatgpt-disagrees\/\" class=\"text link\">Venezuelan president Nicolas Maduro<\/a>. After the operation, a Palantir employee relayed concerns from an Anthropic staffer to US officials about how its models had been used.<\/p>\n<p class=\"paywall\">In negotiations, Anthropic insisted on certain limits on how its models could be deployed, including support of lethal autonomous weapons and mass surveillance systems. But Hegseth rejected any curbs, contending that a contractor could not dictate how the technology could be used once deployed and insisted the contract allowed \u201call lawful use.\u201d<\/p>\n<p class=\"paywall\">After negotiations broke down in February, Hegseth was widely seen as punishing Anthropic by designating it a \u201csupply chain risk,\u201d a national security tool that blacklisted the company from doing business with the federal government.<\/p>\n<p class=\"paywall\">The Pentagon said at the time that the supply chain risk label was appropriate because giving Anthropic access to any classified systems would \u201cintroduce unacceptable risk\u201d if the AI lab could disable or alter its technology, for instance, at a time of war.<\/p>\n<p class=\"paywall\">Anthropic filed two lawsuits in response\u2014one in federal district court in California and one at the US court of appeals for the District of Columbia\u2014accusing the Pentagon of violating its First and Fifth Amendment protections on ideological grounds. The DC case is ongoing.<\/p>\n<p class=\"paywall\">Anthropic\u2019s top AI models are considered some of the best in the world.
