Apple is pushing for \u201cexpedited discovery\u201d in its legal battle against OpenAI over concerns the company is actively destroying evidence, as reported earlier by Bloomberg<\/em><\/a>. In a filing on Monday<\/a>, Apple alleges OpenAI only just handed over a MacBook used by a former employee at the center of the lawsuit, which contained discussions about \u201cdestroying the types of forensic data Apple needs.\u201d<\/p>\n<\/div>\n

\n

This is the latest development in Apple\u2019s lawsuit against<\/a> OpenAI, which accuses the ChatGPT-maker<\/a> of stealing trade secrets to build an AI device. The lawsuit revolves around three former Apple employees who recently joined OpenAI, including Chang Liu, who allegedly kept a company-owned MacBook after leaving Apple.<\/p>\n<\/div>\n

Apple accuses OpenAI of failing to inspect the laptop \u201cdespite having the MacBook in their possession since the start of the lawsuit\u201d in July. Once OpenAI finally provided the laptop to Apple on August 21st, an inspection allegedly found that Liu \u201cnot only downloaded a confidential Apple circuit schematic but also used<\/em> it in his work at OpenAI.\u201d Apple also claims Liu and others at OpenAI were \u201cwell-aware\u201d of Liu\u2019s continued access to Apple\u2019s third-party cloud storage system.<\/p>\n<\/div>\n

Along with these findings, Apple\u2019s inspection uncovered messages in which Liu allegedly discussed \u201cthe need to \u2018restore\u2019 and then \u2018start using\u2019 Apple-owned devices\u201d after finding out about the company\u2019s internal investigation in June. \u201cThe newly discovered evidence demonstrates the very real risk of evidence destruction,\u201d Apple claims. \u201cImportant forensic artifacts on which forensic inspections rely \u2014 such as logs, metadata, and usage records\u2014are transient and at risk of being lost, overwritten, or destroyed.\u201d<\/p>\n<\/div>\n

At the same time, OpenAI argues in a filing that<\/a> \u201cthis dispute is a mess of Apple\u2019s own making,\u201d and that the company is blaming others even though its employee exit process \u201cis a mess.\u201d OpenAI maintains that \u201cthere is no evidence that Liu accessed any Apple information through improper means or for any improper purpose,\u201d adding that \u201cLiu has no use for Apple confidential information.\u201d<\/p>\n<\/div>\n
