{"id":6392,"date":"2026-09-02T19:08:43","date_gmt":"2026-09-02T19:08:43","guid":{"rendered":"https:\/\/silvybrand.com\/?p=6392"},"modified":"2026-09-02T19:08:43","modified_gmt":"2026-09-02T19:08:43","slug":"trump-administration-sides-with-ai-giants-new-york-times-lawsuit","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=6392","title":{"rendered":"Trump Administration Sides With OpenAI in New York Times Copyright Lawsuit"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p>The Trump Administration just took OpenAI\u2019s side in the <a href=\"https:\/\/www.wired.com\/tag\/artificial-intelligence\/\" class=\"text link\">artificial intelligence<\/a> company\u2019s legal battle with the New York Times.<\/p>\n<p class=\"paywall\">The media juggernaut <a href=\"https:\/\/www.wired.com\/story\/the-big-interview-podcast-a-g-sulzberger-new-york-times\/\" class=\"text link\">sued OpenAI and Microsoft<\/a> in 2023, alleging that the companies had violated copyright law by training their AI tools on its articles without permission. Now, the government has stepped in, arguing that OpenAI\u2019s actions were within bounds.<\/p>\n<p class=\"paywall\">On Tuesday, the federal government submitted <a data-offer-url=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.612697\/gov.uscourts.nysd.612697.1464.0.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.612697\/gov.uscourts.nysd.612697.1464.0.pdf&quot;}\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.612697\/gov.uscourts.nysd.612697.1464.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">a letter<\/a> to the court stating that the United States has a \u201cstrong interest\u201d in whether AI training on copyright works is considered \u201cfair use,\u201d because it connects to whether the country\u2019s AI industry can \u201cretain global leadership in artificial intelligence.\u201d (The \u201cfair use\u201d rule shields certain uses of copyrighted materials.)<\/p>\n<p class=\"paywall\">The letter argued that the Times\u2019 definition of fair use is \u201cinconsistent\u201d with current copyright law, and that a win for the paper could have disastrous consequences. \u201cConstraining LLM development under a misunderstanding of fair use doctrine would thwart such creative and scientific progress while hindering American prosperity and economic mobility,\u201d lawyers for the government wrote.<\/p>\n<p class=\"paywall\">While the letter focuses on the New York Times and OpenAI, the government noted that its arguments apply to all of the parties in this case and related cases, including other publishers and authors.<\/p>\n<p class=\"paywall\">Training LLMs on copyrighted works is considered \u201cextraordinarily transformative,\u201d meaning that these systems meaningfully change their inputs, the administration argued. The administration also wrote that OpenAI\u2019s LLMs do not significantly compete with The New York Times\u2019 articles. Courts consider both of these conditions, as well as others, when deciding if the fair use doctrine is met.<\/p>\n<p class=\"paywall\">Conflating AI training with what artificial intelligence tools produce would lead to \u201cproblematic implications for copyright law generally\u201d by implying that it would be similarly illegal for human writers to practice their craft by training on the words of others, per the letter. (The lawyers compared it to how a teenage Joan Didion typed out Ernest Hemingway\u2019s stories to figure out how to write.)<\/p>\n<p class=\"paywall\">Evan Brown, an intellectual property lawyer with the firm Neal &amp; McDevitt, tells WIRED that the US district judge overseeing this case, Sidney H. Stein, is not obliged to let this letter influence his ultimate decision. However, Brown says that Stein and other judges overseeing cases like this will almost certainly \u201ctake it quite seriously because it comes from the Department of Justice, and inherently carries a lot of weight.\u201d<\/p>\n<p class=\"paywall\">Pamela Samuelson, a copyright lawyer who codirects the Berkeley Center For Law &amp; Technology, tells WIRED that the government\u2019s brief is a \u201csignificant development,\u201d and one which is consistent with AI copyright rulings thus far.<\/p>\n<p class=\"paywall\">\u201cThe Administration is siding with a handful of trillion-dollar AI companies at the expense of the countless American creators whose work they stole,\u201d New York Times spokesperson Graham James tells WIRED. \u201cBoth AI and creators can thrive\u2013AI companies simply need to pay fairly for the content that makes their products possible, as copyright law requires.\u201d<\/p>\n<p class=\"paywall\">OpenAI and Microsoft did not immediately respond to WIRED\u2019s request for comment.<\/p>\n<p class=\"paywall\">Other plaintiffs are unhappy at the government\u2019s incursion. Mary Rasenberger, the chief executive of the Author\u2019s Guild\u2014which filed its own lawsuit against OpenAI in 2023\u2014tells WIRED that the nonprofit is \u201cextremely disappointed\u201d about the letter, which she calls \u201dreplete with faulty arguments and a gross misunderstanding of the fair use doctrine and copyright law.\u201d<\/p>\n<p class=\"paywall\">There are <a href=\"https:\/\/www.wired.com\/story\/ai-copyright-case-tracker\/\" class=\"text link\">dozens<\/a> of ongoing, high-profile lawsuits over the legality of AI companies training their tools on copyrighted work. The two biggest decisions so far took place last year. Meta <a href=\"https:\/\/www.wired.com\/story\/meta-scores-victory-ai-copyright-case\/\" class=\"text link\">technically won<\/a> its copyright case, <em>Kadrey v.
