REI did not respond to questions about whether it had complied with the request and, if so, how many people are affected.<\/p>\n<p class=\"paywall\">The filings are part of a broader lawsuit by the federal government against 39 people who attended an ICE protest at a church whose pastor also <a data-offer-url=\"https:\/\/www.mprnews.org\/story\/2026\/01\/19\/protesters-interrupt-service-at-cities-church-in-st-paul-claiming-pastor-works-for-ice\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.mprnews.org\/story\/2026\/01\/19\/protesters-interrupt-service-at-cities-church-in-st-paul-claiming-pastor-works-for-ice&quot;}\" href=\"https:\/\/www.mprnews.org\/story\/2026\/01\/19\/protesters-interrupt-service-at-cities-church-in-st-paul-claiming-pastor-works-for-ice\" rel=\"nofollow noopener\" target=\"_blank\">worked<\/a> as an acting ICE field office director. Both protesters and journalists who were attempting to cover the event, including former CNN host Don Lemon, are now defendants.<\/p>\n<p class=\"paywall\">The subpoena to REI was <a data-offer-url=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.231102\/gov.uscourts.mnd.231102.696.3.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.231102\/gov.uscourts.mnd.231102.696.3.pdf&quot;}\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.231102\/gov.uscourts.mnd.231102.696.3.pdf\" rel=\"nofollow noopener\" target=\"_blank\">one of 92 sent<\/a> as part of HSI\u2019s investigation into the defendants, according to the court filings. Other recipients included social media companies, airlines, telecom providers, a car rental company, and a state employment agency. At least one subpoena sent to an unnamed airline, the filings allege, asked not only for information about a defendant\u2019s past flights, but also requested that the airline give HSI a \u201clookout notification\u201d about the defendant\u2019s travel in the future. DHS declined to comment. The US Attorney\u2019s Office in Minnesota, which is litigating the case on behalf of the government, did not respond questions about why it was necessary to identify everyone in Minnesota who purchased the beanie from REI, or why it specifically targeted REI customers, since the beanie is sold on other platforms as well.<\/p>\n<p class=\"paywall\">The subpoenas sent by HSI agents are also known as <a href=\"https:\/\/www.wired.com\/story\/ice-1509-custom-summons\/\" class=\"text link\">1509 customs summons<\/a>, and are meant to be used to request information related to imports and exports. However, since the start of the Trump administration, <a href=\"https:\/\/www.wired.com\/story\/dhs-demanded-google-surrender-data-on-canadians-activity-location-over-anti-ice-posts\/\" class=\"text link\">WIRED<\/a> and <a data-offer-url=\"https:\/\/theintercept.com\/2025\/09\/18\/dhs-subpoena-ice-instagram-dox\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/theintercept.com\/2025\/09\/18\/dhs-subpoena-ice-instagram-dox\/&quot;}\" href=\"https:\/\/theintercept.com\/2025\/09\/18\/dhs-subpoena-ice-instagram-dox\/\" rel=\"nofollow noopener\" target=\"_blank\">other<\/a> <a data-offer-url=\"https:\/\/www.theguardian.com\/us-news\/2026\/aug\/29\/trump-dhs-1509-summons-records-journalists-nonprofits\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.theguardian.com\/us-news\/2026\/aug\/29\/trump-dhs-1509-summons-records-journalists-nonprofits&quot;}\" href=\"https:\/\/www.theguardian.com\/us-news\/2026\/aug\/29\/trump-dhs-1509-summons-records-journalists-nonprofits\" rel=\"nofollow noopener\" target=\"_blank\">news<\/a> <a data-offer-url=\"https:\/\/www.wsj.com\/politics\/policy\/ice-surveillance-internet-critics-e3b22f49\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.wsj.com\/politics\/policy\/ice-surveillance-internet-critics-e3b22f49&quot;}\" href=\"https:\/\/www.wsj.com\/politics\/policy\/ice-surveillance-internet-critics-e3b22f49\" rel=\"nofollow noopener\" target=\"_blank\">outlets<\/a> have reported on DHS\u2019s attempts to unmask online critics using the legal tool, which can be sent without the oversight of a judge or a jury.<\/p>\n<p class=\"paywall\">\u201cIt\u2019s flat-out absurd for DHS to demand REI search two years of customer data as part of Trump\u2019s campaign against the people of Minneapolis,\u201d US senator Ron Wyden of Oregon tells WIRED. \u201cCustoms summonses only allow DHS to request information directly related to compliance with customs laws, not to conduct unending fishing expeditions into the lives of people critical of Donald Trump.\u201d<\/p>\n<p class=\"paywall\">The total number of 1509 summonses that have been sent since the start of the Trump administration\u2014and how many people have had their personal information guzzled up by DHS as a result\u2014is unknown. Companies that receive these types of subpoenas are typically asked to keep their existence a secret. When the public has gotten a glimpse of them, it\u2019s usually because the target has contested it in court, either because the recipient company ignored the request for silence and notified the target, or because the target discovered it after the fact.<\/p>\n<p class=\"paywall\">According to a <a href=\"https:\/\/www.wyden.senate.gov\/imo\/media\/doc\/wyden_jayapal_letter_to_gao_and_scotus_on_federal_law_enforcement_non_disclosure_subpeanas.pdf\" class=\"text link\">recent letter<\/a> written by Wyden and Representative Pramila Jayapal, big tech companies will sometimes ignore the government\u2019s request for silence when not legally required, but other companies in more heavily regulated sectors have told Congress that they\u2019ve complied because of fear of regulatory retaliation.<\/p>\n<p class=\"paywall\">Court filings, internal DHS documents, and companies\u2019 own public statements show that companies have responded to recent customs summons in different ways.<\/p>\n<p class=\"paywall\">Attorneys for Georgia Fort, a journalist and one of the defendants in the Minnesota case, wrote in a <a data-offer-url=\"https:\/\/www.documentcloud.org\/documents\/28584281-77419080-d795-4a75-9969-d90351bda90d\/?mode=document\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.documentcloud.org\/documents\/28584281-77419080-d795-4a75-9969-d90351bda90d\/?mode=document&quot;}\" href=\"https:\/\/www.documentcloud.org\/documents\/28584281-77419080-d795-4a75-9969-d90351bda90d\/?mode=document\" rel=\"nofollow noopener\" target=\"_blank\">court filing<\/a> that they were \u201cstunned\u201d when they realized that the government had obtained logs detailing six months\u2019 of Fort\u2019s calls and text messages from T-Mobile after the government sent a customs summons to the telecom provider.
