New Mexico\u2019s Supreme Court is punishing a lawyer for including AI-fabricated witnesses and fake police testimony in an appeal for his client\u2019s murder conviction, according to a report from Reuters<\/em><\/a>. In a filing on Wednesday<\/a>, the court fined Stephen Aarons $5,000 and held him in contempt for failing to \u201cverify the factual claims and legal authority in his AI-generated brief.\u201d<\/p>\n<\/div>\n

The filing says the brief \u201ccontained false testimony from wholly fabricated witnesses,\u201d along with \u201cfalse testimony\u201d about the shooter\u2019s clothing and appearance. Justice C. Shannon Bacon questioned how Aarons wasn\u2019t aware of the risks posed by AI during an August hearing, where he admitted to using ChatGPT and thinking it would generate a \u201cbulletproof summary\u201d of the trial. \u201cCounsel, do you watch the news? Do you \u200blisten to the radio? Do you read anything about what\u2019s going on in the world?\u201d Justice Bacon said, according to Reuters<\/em>. \u201cBecause the problem with \u200blawyers relying on AI hallucinations is an above-the-fold story every single day.\u201d<\/p>\n<\/div>\n

\u201dI am remorseful but hopeful that the disciplinary board takes into account it was an honest mistake,\u201d Aarons says in a statement to Reuters<\/em>.<\/p>\n<\/div>\n
