Donald Trump\u2013appointed judge Kurt Engelhardt <a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/24\/24-60370-CV1.pdf\" class=\"text link\">disagreed<\/a>. \u201cThe Constitution does not provide redress for every governmental wrongdoing,\u201d <a data-offer-url=\"https:\/\/news.bloomberglaw.com\/us-law-week\/jackson-residents-lose-bid-to-revive-water-contamination-claims\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/news.bloomberglaw.com\/us-law-week\/jackson-residents-lose-bid-to-revive-water-contamination-claims&quot;}\" href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/jackson-residents-lose-bid-to-revive-water-contamination-claims\" rel=\"nofollow noopener\" target=\"_blank\">Engelhardt said<\/a>. \u201cDefendants\u2019 actions allegedly deprived Plaintiffs of clean water and guileless information. These deprivations, while grievous, do not infringe upon any deeply rooted constitutional right.\u201d<\/p>\n<p class=\"paywall\">That may be true in Mississippi\u2014but on the state level in at least nine US states, and in more than a dozen other countries, clean drinking water is in fact a protected right. In countries including <a href=\"https:\/\/hir.harvard.edu\/running-dry-the-battle-for-water-security-in-uruguay-and-why-it-foreshadows-a-greater-issue\/\" class=\"text link\">Uruguay<\/a> and <a data-offer-url=\"https:\/\/www.gov.za\/news\/media-statements\/water-and-sanitation-water-security-south-africa-parliament-12-nov-2024\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.gov.za\/news\/media-statements\/water-and-sanitation-water-security-south-africa-parliament-12-nov-2024&quot;}\" href=\"https:\/\/www.gov.za\/news\/media-statements\/water-and-sanitation-water-security-south-africa-parliament-12-nov-2024\" rel=\"nofollow noopener\" target=\"_blank\">South Africa<\/a>, a right to clean water is enshrined in the constitution. New York\u2019s state constitution, as of <a data-offer-url=\"https:\/\/nygreen.pace.edu\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/nygreen.pace.edu\/&quot;}\" href=\"https:\/\/nygreen.pace.edu\/\" rel=\"nofollow noopener\" target=\"_blank\">a 2021 amendment<\/a>, states that \u201ceach person shall have a right to clean air and water, and a healthful environment.\u201d So too in Massachusetts, where \u201cthe right to clean air and water\u201d has been <a data-offer-url=\"https:\/\/codes.findlaw.com\/ma\/massachusetts-constitution\/ma-const-amend-art-xlix\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/codes.findlaw.com\/ma\/massachusetts-constitution\/ma-const-amend-art-xlix\/&quot;}\" href=\"https:\/\/codes.findlaw.com\/ma\/massachusetts-constitution\/ma-const-amend-art-xlix\/\" rel=\"nofollow noopener\" target=\"_blank\">constitutionally protected since 1972<\/a>.<\/p>\n<p class=\"paywall\">But according to the Fifth Circuit ruling, the US constitution is too narrow for such a claim. The Jackson plaintiffs alleged that their city government deliberately withheld information about the water\u2019s toxicity and exacerbated the problem through a series of <a href=\"https:\/\/www.wired.com\/story\/the-summer-the-american-water-crisis-turned-real\/\" class=\"text link\">boil-water notices<\/a>\u2014a practice that can eliminate some bacterial contamination, but also concentrates lead in water. Engelhardt stated there is no \u201cconstitutional right to truthful information from officials during a public health crisis.\u201d<\/p>\n<p class=\"paywall\">Jackson is more than 80 percent Black and has a poverty rate that is more than double the national average. The city\u2019s water system has long been <a data-offer-url=\"https:\/\/grist.org\/accountability\/jackson-water-crisis-mississippi-epa-inspector-general-report\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/grist.org\/accountability\/jackson-water-crisis-mississippi-epa-inspector-general-report\/&quot;}\" href=\"https:\/\/grist.org\/accountability\/jackson-water-crisis-mississippi-epa-inspector-general-report\/\" rel=\"nofollow noopener\" target=\"_blank\">in dire need of upgrades<\/a>. In 2015, officials from the Mississippi State Department of Health found elevated lead levels in the water supply. Instead of immediately informing citizens, they <a data-offer-url=\"https:\/\/grist.org\/accountability\/jackson-water-crisis-mississippi-epa-inspector-general-report\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/grist.org\/accountability\/jackson-water-crisis-mississippi-epa-inspector-general-report\/&quot;}\" href=\"https:\/\/grist.org\/accountability\/jackson-water-crisis-mississippi-epa-inspector-general-report\/\" rel=\"nofollow noopener\" target=\"_blank\">remained silent about the issue for six months<\/a>, according to reporting from Grist, while residents continued drinking toxic water.<\/p>\n<p class=\"paywall\">EPA officials ran a series of tests in 2020 and found \u201cpersistent and concerning violations\u201d of water safety policy, including leaks, corrosion, and high lead levels throughout the system.<\/p>\n<p class=\"paywall\">But no city, state, or federal agency fixed the problem. Meanwhile, people, including Jackson plaintiff Priscilla Sterling, continued\u00a0<a href=\"https:\/\/www.wired.com\/story\/is-expensive-bottled-water-actually-better-for-you\/\" target=\"_blank\" class=\"text link\">drinking water<\/a>\u00a0with unsafe levels of lead. According to the 2022 lawsuit, several of Sterling\u2019s children have since been diagnosed with lead poisoning, which can cause permanent brain damage.
