{"id":7127,"date":"2026-09-16T14:57:32","date_gmt":"2026-09-16T14:57:32","guid":{"rendered":"https:\/\/silvybrand.com\/?p=7127"},"modified":"2026-09-16T14:57:32","modified_gmt":"2026-09-16T14:57:32","slug":"the-eu-bans-social-media-for-under-13s","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=7127","title":{"rendered":"The EU Plans to Ban Social Media For Under-13s"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">The European Union<\/span> has announced plans to restrict <a href=\"https:\/\/www.wired.com\/story\/europe-gets-serious-about-age-verification-online\/\" class=\"text link\">children\u2019s access to social media across<\/a> member states in a bid to free them from what President of the Commission Ursula von der Leyen described as the \u201ccapture [of] their attention, their focus, their minds\u201d by the platforms.<\/p>\n<p class=\"paywall\">The proposal for a total ban on social media for children under 13 was announced in Wednesday\u2019s State of the Union speech, where von der Leyen set out the Union\u2019s priorities for the year ahead.<\/p>\n<p class=\"paywall\">It\u2019s part of an EU Kids Act, which the Commission will unveil fully on Thursday. Children aged 13 to 15 will also not be allowed personal social media accounts but will be able to access social media through mini accounts set up and supervised by parents and guardians, with limited features, for one hour per day. Platforms will also have safe design obligations for users up to 18, with the Union planning to tackle addictive design further in the upcoming Digital Fairness Act in Autumn.<\/p>\n<p class=\"paywall\">\u201cI am aware that many perceive <a href=\"https:\/\/www.wired.com\/story\/european-commission-big-tech-regulation-outlook\/\" class=\"text link\">the power of Big Tech<\/a> as overwhelming and impossible to roll back. I disagree,\u201d von der Leyen told the European Parliament. \u201cWe do not have to accept addictive features, we do not have to accept children being drawn into ever more extreme content, we do not have to accept that girls have their photos used for-AI generated sexualised images,\u201d she added. \u201cEurope has the power to act; it is us who decide the rules, not Big Tech.\u201d<\/p>\n<p class=\"paywall\">The EU was largely expected to follow other countries in restricting children\u2019s access to social media, which von der Leyen said has been responsible for sleep loss, anxiety, self harm, and even the deaths of European children. Seventeen of the bloc\u2019s 27 member states are already negotiating or preparing draft legislation to protect minors online, including by setting out a minimum age to access certain services. Among those is France, whose top court last month struck down a ban on social media for under-15s because it infringed upon freedom of expression.<\/p>\n<p class=\"paywall\">\u201cCleaning up that mess, getting everyone on the same page, then running through the EU legislative process,\u201d will probably take until 2029, expects Ashurst Perkins Coie technology lawyer Arnav Joshi. Still, he believes companies will welcome the clarity and simplicity provided by a single set of EU-wide rules. The tiered approach is designed to placate any judicial challenges by being proportionate\u2014a rare example of where \u201cthe EU law, by not introducing a blanket ban, is perhaps even a little bit more permissive than others,\u201d he told WIRED, referencing the sweeping social media bans in the <a href=\"https:\/\/www.wired.com\/story\/uk-social-media-under-16-ban\/\" class=\"text link\">UK<\/a> and <a href=\"https:\/\/www.wired.com\/story\/kids-and-teen-influencers-in-australia-say-goodbye-to-social-media\/\" class=\"text link\">Australia<\/a>.<\/p>\n<p class=\"paywall\">But the measures still force oversight on both guardians and the <a href=\"https:\/\/www.wired.com\/story\/banning-social-media-for-kids-is-a-bad-idea\/\" class=\"text link\">social media platforms<\/a> themselves, which could risk privacy infringements. Parental monitoring could be \u201cproblematic\u201d says Joshi, who advises global technology companies on children\u2019s online safety, warning: \u201canything that has deep dive, God-mode style parental access can have a bit of a chilling effect on how children actually use that service and could have issues in terms of their own right to privacy.\u201d<\/p>\n<p class=\"paywall\">The European bloc will also face similar <a href=\"https:\/\/www.wired.com\/story\/vpn-use-spike-age-verification-laws-uk\/\" class=\"text link\">challenges to other countries<\/a> in effectively enforcing the age limits. Children in Australia have widely been able to <a data-offer-url=\"https:\/\/www.esafety.gov.au\/sites\/default\/files\/2026-03\/SocialMediaMinimumAgeComplianceUpdateMarch2026.pdf?v=1774906254844\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.esafety.gov.au\/sites\/default\/files\/2026-03\/SocialMediaMinimumAgeComplianceUpdateMarch2026.pdf?v=1774906254844&quot;}\" href=\"https:\/\/www.esafety.gov.au\/sites\/default\/files\/2026-03\/SocialMediaMinimumAgeComplianceUpdateMarch2026.pdf?v=1774906254844\" rel=\"nofollow noopener\" target=\"_blank\">circumvent<\/a> the country\u2019s under-16s ban on social media access. &#8220;A key issue is how to carry out the age checks and it\u2019s not straightforward,\u201d Joanna Conway, digital regulation partner at law firm Norton Rose Fulbright, told WIRED. Making age checks accurate, without infringing on privacy rights or harming user experience, is a challenge, she added.
