{"id":7152,"date":"2026-09-16T21:53:50","date_gmt":"2026-09-16T21:53:50","guid":{"rendered":"https:\/\/silvybrand.com\/?p=7152"},"modified":"2026-09-16T21:53:50","modified_gmt":"2026-09-16T21:53:50","slug":"washington-wont-be-regulating-ai-anytime-soon","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=7152","title":{"rendered":"Washington Won\u2019t Be Regulating AI Anytime Soon"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">For weeks, Washington<\/span> has been abuzz with talk of needing to push through <a href=\"https:\/\/www.wired.com\/story\/ai-leaders-are-calling-for-a-slowdown-trumps-team-says-its-on-them\/\" class=\"text link\">some sort of AI regulation<\/a> amid mounting concerns about the risks of highly capable frontier AI models going rogue.<\/p>\n<p class=\"paywall\">But there is no reason to think any one measure can win the support of the White House, where officials have paused work on creating a FINRA-style regulatory body after <a href=\"https:\/\/www.wired.com\/tag\/donald-trump\/\" class=\"text link\">President Donald Trump<\/a> soured on the idea, or of Capitol Hill, where lawmakers have competing proposals that lack the votes to pass.<\/p>\n<p class=\"paywall\">White House aides initially started sketching out a framework for an AI oversight agency connected to the administration soon after Google DeepMind\u2019s cofounder Demis Hassabis floated the idea in a <a data-offer-url=\"https:\/\/x.com\/demishassabis\/article\/2076957440109625718?lang=en\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/demishassabis\/article\/2076957440109625718?lang=en&quot;}\" href=\"https:\/\/x.com\/demishassabis\/article\/2076957440109625718?lang=en\" rel=\"nofollow noopener\" target=\"_blank\">July 14 essay<\/a> and in briefings to senior officials, according to sources familiar with the matter.<\/p>\n<p class=\"paywall\">The Treasury Department and the White House\u2019s Office of Science and Technology Policy envisioned a body where leading AI labs would self-regulate the development of frontier models, and they put together a preliminary draft to see what it could look like if executed.<\/p>\n<p class=\"paywall\">But when a <a href=\"https:\/\/www.wired.com\/story\/ai-leaders-are-calling-for-a-slowdown-trumps-team-says-its-on-them\/\" class=\"text link\">chorus of tech executives<\/a>\u2014including Trump\u2019s former AI czar David Sacks and Meta CEO Mark Zuckerberg\u2014learned of the effort, they one by one called Trump in August to express their opposition. The proposal has since been left in limbo.<\/p>\n<p class=\"paywall\">Since then, there have been no new AI oversight proposals seriously under consideration at the White House, the sources say, not least as Trump has doubled down in recent days of rejecting any overt regulation and called AI safety concerns a \u201choax\u201d in a recent Truth Social post.<\/p>\n<p class=\"paywall\">Trump\u2019s ire has stemmed at least in part from a <a data-offer-url=\"https:\/\/darioamodei.com\/post\/we-must-pace-the-frontier\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/darioamodei.com\/post\/we-must-pace-the-frontier&quot;}\" href=\"https:\/\/darioamodei.com\/post\/we-must-pace-the-frontier\" rel=\"nofollow noopener\" target=\"_blank\">3,822 word missive<\/a> by <a href=\"https:\/\/www.wired.com\/tag\/anthropic\/\" class=\"text link\">Anthropic<\/a> CEO Dario Amodei on the dangers of frontier AI. Trump\u2019s aides, one of the sources said, viewed it as stirring anxieties that caused unnecessary headaches for the administration\u2014even as it represents a fairly moderate position within AI circles.<\/p>\n<p class=\"paywall\">In the absence of the White House taking the lead, several bills have sprung up in Congress\u2014but with no voting days left on the House calendar until after the midterm elections and a lack of unity around even one bill, the odds of anything passing are extraordinarily slim.<\/p>\n<h2 class=\"paywall\">Independent Auditors<\/h2>\n<p class=\"paywall\">The bipartisan <a href=\"https:\/\/trahan.house.gov\/news\/documentsingle.aspx?DocumentID=3823\" class=\"text link\">Frontier Act<\/a>, a bill introduced this summer by House Democratic senior whip Lori Trahan and Republican House Energy and Commerce Committee member Jay Obernolte, is widely seen as having the most support inside the House Democratic caucus as well as among AI executives.<\/p>\n<p class=\"paywall\">As drafted, the bill would enable the Commerce Department to have auditors embedded at AI labs, who could report critical safety incidents and empower the administration to stop development if a model poses catastrophic risk.<\/p>\n<p class=\"paywall\">But despite public <a data-offer-url=\"https:\/\/www.politico.com\/news\/2026\/09\/15\/openai-backs-bipartisan-house-plan-for-third-party-safety-assessments-01076588\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.politico.com\/news\/2026\/09\/15\/openai-backs-bipartisan-house-plan-for-third-party-safety-assessments-01076588&quot;}\" href=\"https:\/\/www.politico.com\/news\/2026\/09\/15\/openai-backs-bipartisan-house-plan-for-third-party-safety-assessments-01076588\" rel=\"nofollow noopener\" target=\"_blank\">backing from OpenAI<\/a>, the White House has been undecided on whether to support the concept of using independent auditors amid skepticism from AI accelerationists about regulatory capture and from national security hawks over China.<\/p>\n<p class=\"paywall\">The principal argument against the idea from Trumpworld is that even if auditors determine that a model is dangerous and needs to be taken offline, there is no guarantee that China will also pause development or stop trying to <a href=\"https:\/\/www.wired.com\/story\/the-white-house-is-trying-to-figure-out-what-to-do-about-chinese-ai\/\" class=\"text link\">reverse engineer<\/a> frontier AI weights.<\/p>\n<p class=\"paywall\">There would then be immense pressure to lift any emergency pauses in development in order to stay ahead of China, defeating the entire premise of having auditors to push the Commerce Department to take models offline.<\/p>\n<p class=\"paywall\">Still, the main issue for the Frontier Act remains partisan politics.
