{"id":7209,"date":"2026-09-17T20:09:42","date_gmt":"2026-09-17T20:09:42","guid":{"rendered":"https:\/\/silvybrand.com\/?p=7209"},"modified":"2026-09-17T20:09:42","modified_gmt":"2026-09-17T20:09:42","slug":"the-ai-slowdown-is-an-antitrust-mess","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=7209","title":{"rendered":"The AI \u2018Slowdown\u2019 Is an Antitrust Mess"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">Following multiple reports<\/span> of <a href=\"https:\/\/www.wired.com\/story\/openai-models-escaped-containment-and-hacked-huggingface\/\" class=\"text link\">AI agent swarms<\/a> <a href=\"https:\/\/www.wired.com\/story\/anthropic-says-claude-hacked-real-systems-during-cybersecurity-tests\/\" class=\"text link\">hacking websites<\/a> and coordinating via <a href=\"https:\/\/www.wired.com\/story\/openai-didnt-notice-its-ai-agents-using-a-message-board-to-plan-their-hacking-spree\/\" class=\"text link\">secret message boards<\/a>, along with a <a href=\"https:\/\/www.wired.com\/story\/anthropic-researcher-quits-jacob-coxon-ai-fears-humanity\/\" class=\"text link\">dire message for humanity<\/a> from an outgoing Anthropic engineer, leading AI companies have called for a <a href=\"https:\/\/www.wired.com\/story\/ai-leaders-are-calling-for-a-slowdown-trumps-team-says-its-on-them\/\" class=\"text link\">coordinated AI development \u201cslowdown<\/a>.\u201d Alongside various versions of this specific phrase\u2014slowdown\u2014they\u2019ve also expressed concerns that doing so would run afoul of antitrust laws.<\/p>\n<p class=\"paywall\">Antitrust experts say that while the companies\u2019 charged language isn\u2019t necessarily doing them any favors, the unrestrained development of a rogue killer AI probably isn\u2019t in line with the spirit of the Sherman Act, a key US antitrust law that exists to promote a competitive marketplace. At the same time, getting an official all-clear from the government to move forward could ward off costly investigations down the line.<\/p>\n<h2 class=\"paywall\">Radical Rhetoric<\/h2>\n<p class=\"paywall\">Under antitrust law, how a company\u2019s employees talk about business decisions is often as important as the business decisions themselves. Google famously <a data-offer-url=\"https:\/\/themarkup.org\/google-the-giant\/2020\/08\/07\/google-documents-show-taboo-words-antitrust\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/themarkup.org\/google-the-giant\/2020\/08\/07\/google-documents-show-taboo-words-antitrust&quot;}\" href=\"https:\/\/themarkup.org\/google-the-giant\/2020\/08\/07\/google-documents-show-taboo-words-antitrust\" rel=\"nofollow noopener\" target=\"_blank\">trained its employees<\/a> not to use certain phrases\u2014even internally\u2014that could imply it was engaging in anticompetitive behavior, and instead instructed them to emphasize the ways that business decisions would improve its offerings and benefit consumers.<\/p>\n<p class=\"paywall\">So from an antitrust perspective, the use of phrases like \u201c<a data-offer-url=\"https:\/\/www.anthropic.com\/institute\/recursive-self-improvement\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.anthropic.com\/institute\/recursive-self-improvement&quot;}\" href=\"https:\/\/www.anthropic.com\/institute\/recursive-self-improvement\" rel=\"nofollow noopener\" target=\"_blank\">a slowdown<\/a>\u201d or \u201c<a data-offer-url=\"https:\/\/darioamodei.com\/post\/we-must-pace-the-frontier\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/darioamodei.com\/post\/we-must-pace-the-frontier&quot;}\" href=\"https:\/\/darioamodei.com\/post\/we-must-pace-the-frontier\" rel=\"nofollow noopener\" target=\"_blank\">a pause<\/a>\u201d may set off more alarms than the actual activity it represents: developing ways to ensure that advanced AI models don\u2019t go rogue. A collectively agreed-upon slowdown without any particular purpose could be interpreted by regulators as an anticompetitive agreement to reduce trade.<\/p>\n<p class=\"paywall\">\u201cI think they kind of boxed themselves into a corner with the way they phrase things,\u201d says John Bergmayer, legal counsel for the nonprofit Public Knowledge.<\/p>\n<p class=\"paywall\">\u201cUsually in antitrust, one of the things that the economists look at is whether you&#8217;re reducing output,\u201d says Bergmayer, which is to say, whether two or more companies are making a pact to \u201ckind of take it easy.\u201d Rather than talk about some collusive-sounding effort to dial back development, he says, AI companies could have just emphasized their desire to work on safety protocols together to prevent catastrophic risks and treated a slowdown in model releases as a natural side-effect of that.<\/p>\n<p class=\"paywall\">Meta CEO Mark Zuckerberg, whose company recently dodged a massive antitrust suit brought by the Federal Trade Commission, <a data-offer-url=\"https:\/\/x.com\/finkd\/status\/2099997096896274533?s=20\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/finkd\/status\/2099997096896274533?s=20&quot;}\" href=\"https:\/\/x.com\/finkd\/status\/2099997096896274533?s=20\" rel=\"nofollow noopener\" target=\"_blank\">chimed in on the slowdown proposal<\/a> by not endorsing an explicit \u201cslowdown\u201d at all. Zuckerberg instead argued that AI labs have a \u201cstrong natural incentive\u201d to make AI agents behave better because consumers don\u2019t want models doing things people don\u2019t intend\u2014known as \u201cmisalignment\u201d in AI industry jargon\u2014and that the companies that don\u2019t take the time to get alignment right \u201cwill fall behind\u201d competitively. It\u2019s the difference between two automakers saying \u201cwe\u2019ve agreed to not make better cars for a while\u201d and saying \u201cwe\u2019re not making faster cars until we figure out how to make them safe, because no one will buy our cars if they kill people.\u201d<\/p>\n<p class=\"paywall\">(<em>Disclosure: The reporter on this story previously worked at the FTC but did not participate in the Meta case.<\/em>)<\/p>\n<p class=\"paywall\">David Lawrence, until recently a policy director of the Department of Justice\u2019s Antitrust Division, <a data-offer-url=\"https:\/\/www.linkedin.com\/posts\/david-lawrence-23b40425_i-think-its-important-to-be-very-clear-eyed-share-7503952758442639361-VOev\/?utm_source=social_share_send&amp;utm_medium=ios_app&amp;rcm=ACoAABFJbs4BYMXtq4XddpVUASD2GpZFshYV7yE\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.linkedin.com\/posts\/david-lawrence-23b40425_i-think-its-important-to-be-very-clear-eyed-share-7503952758442639361-VOev\/?utm_source=social_share_send&amp;utm_medium=ios_app&amp;rcm=ACoAABFJbs4BYMXtq4XddpVUASD2GpZFshYV7yE&quot;}\" href=\"https:\/\/www.linkedin.com\/posts\/david-lawrence-23b40425_i-think-its-important-to-be-very-clear-eyed-share-7503952758442639361-VOev\/?utm_source=social_share_send&amp;utm_medium=ios_app&amp;rcm=ACoAABFJbs4BYMXtq4XddpVUASD2GpZFshYV7yE\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a> on LinkedIn that agreements that prevent catastrophic risks actually \u201cincrease output and promote competition\u201d and are already protected under the law by something called the \u201cancillary restraints doctrine.\u201d<\/p>\n<p class=\"paywall\">\u201cAfter all,\u201d a career FTC antitrust attorney commented below the post, \u201cno humanity would result in no competition.\u201d<\/p>\n<p class=\"paywall\">If anything, collectively agreeing not to implement safety measures could expose the AI labs to allegations of \u201c<a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/12F347CD-5056-A066-60D3-6CE8AE18B459\/Alford%20Testimony1.pdf\" class=\"text link\">quality fixing<\/a>,\u201d says Roger Alford, a professor at Notre Dame Law School and the former second-in-command for the DOJ Antitrust Division. That\u2019s when companies mutually agree not to improve their own products; Alford points to a <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/pl\/ip_21_3581\" class=\"text link\">European antitrust case<\/a> in which car companies worked together to develop emissions-reducing technology but agreed to not compete on improvements beyond what the law required.
