{"id":7644,"date":"2026-09-25T12:00:30","date_gmt":"2026-09-25T12:00:30","guid":{"rendered":"https:\/\/silvybrand.com\/?p=7644"},"modified":"2026-09-25T12:00:30","modified_gmt":"2026-09-25T12:00:30","slug":"trump-administration-is-trying-to-get-musk-and-x-out-of-a-dollar137-million-eu-fine","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=7644","title":{"rendered":"The Trump Administration Is Trying to Get Musk and X Out of a $137 Million EU Fine"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">The US government<\/span> is trying to get <a href=\"https:\/\/www.wired.com\/tag\/elon-musk\/\" class=\"text link\">Elon Musk<\/a> and his social media platform <a href=\"https:\/\/www.wired.com\/tag\/twitter\/\" class=\"text link\">X<\/a> out of a $137 million fine by the European Union in an escalation of its criticism of the bloc\u2019s tech rules.<\/p>\n<p class=\"paywall\">The <a href=\"https:\/\/www.wired.com\/tag\/department-of-justice\/\" class=\"text link\">US Department of Justice<\/a> said it had filed an application with the help of the Department of State to support a legal challenge by Musk to annul the case in the EU\u2019s General Court. The Luxembourg-based court will now decide whether the US has a right to intervene.<\/p>\n<p class=\"paywall\">The US government is arguing that it should be involved in the case to protect American companies. The fine is precedent-setting as the bloc\u2019s first sanction under the <a href=\"https:\/\/www.wired.com\/story\/digital-services-act-regulation\/\" class=\"text link\">Digital Services Act<\/a>, which requires online platforms to do more to tackle illegal and harmful content, especially the largest sites. Many of those, which include <a href=\"https:\/\/www.wired.com\/tag\/meta\/\" class=\"text link\">Meta\u2019s Facebook<\/a> and <a href=\"https:\/\/www.wired.com\/tag\/instagram\/\" class=\"text link\">Instagram<\/a>, Google\u2019s <a href=\"https:\/\/www.wired.com\/tag\/youtube\/\" class=\"text link\">YouTube<\/a>, and Microsoft\u2019s <a href=\"https:\/\/www.wired.com\/tag\/linkedin\/\" class=\"text link\">LinkedIn<\/a>, are headquartered in the US and contribute significantly to the US economy, it pointed out.<\/p>\n<p class=\"paywall\">\u201cWe will not tolerate the European Commission engaging in regulatory overreach to try and control American engines of innovation and economic growth,\u201d said Assistant Attorney General Brett A. Shumate of the <a href=\"https:\/\/www.wired.com\/story\/the-justice-department-has-destroyed-its-voting-rights-section\/\" class=\"text link\">Justice Department\u2019s Civil Division<\/a>.<\/p>\n<p class=\"paywall\">The case also has \u201cimplications\u201d for <a href=\"https:\/\/www.wired.com\/story\/all-the-ways-europe-is-ditching-american-technology\/\" class=\"text link\">US-EU relations<\/a>, it warned. The act has become a major source of tension between officials, with US President <a href=\"https:\/\/www.wired.com\/tag\/donald-trump\/\" class=\"text link\">Donald Trump<\/a> calling the penalties \u201coverseas extortion.\u201d Last year, he threatened imposing <a href=\"https:\/\/www.wired.com\/story\/uncanny-valley-podcast-trump-tariffs-tech-industry\/\" class=\"text link\">tariffs<\/a> on any country implementing digital regulation, which he said were \u201call designed to harm, or discriminate against, American technology.\u201d Vice President <a href=\"https:\/\/www.wired.com\/tag\/jd-vance\/\" class=\"text link\">JD Vance<\/a> has criticized the DS\u2019s content moderation rules as \u201cauthoritarian censorship.\u201d<\/p>\n<p class=\"paywall\">The European Commission slapped X with the \u20ac120 million fine in December following a two-year-long investigation which found X had breached transparency obligations. Claiming users with <a href=\"https:\/\/www.wired.com\/story\/eu-elon-musk-x-blue-checks\/\" class=\"text link\">blue checkmarks are \u201cverified accounts\u201d<\/a> when they simply have to pay for the status is deceptive, the Commission ruled. X\u2019s inaccessible and incomplete advertising repository and <a href=\"https:\/\/www.wired.com\/story\/european-researchers-want-to-study-social-medias-harms-but-cant-get-the-data\/\" class=\"text link\">failure<\/a> to provide access to public data for researchers is also hindering research into the platform\u2019s risks, it said. The EU\u2019s investigation was \u201cincomplete and superficial\u201d and the interpretation of the DSA obligations \u201ctortured,\u201d they said. They also complained they had not been given \u201crights of defence \u2026 suggesting prosecutorial bias.\u201d<\/p>\n<p class=\"paywall\">Musk has also complained about the financial and administrative burden of heightened transparency requirements as governments globally try to get a better understanding of\u2014and limit\u2014social media platforms\u2019 risks of harm. In July, he <a href=\"https:\/\/www.wired.com\/story\/x-says-australias-under-16s-social-media-bans-risk-interfering-with-foreign-law\/\" class=\"text link\">argued<\/a> Australia\u2019s \u201cinvasive\u201d information-gathering powers within the country\u2019s under-16 social media ban interfered with international law.
