{"id":7861,"date":"2026-09-29T20:45:31","date_gmt":"2026-09-29T20:45:31","guid":{"rendered":"https:\/\/silvybrand.com\/?p=7861"},"modified":"2026-09-29T20:45:31","modified_gmt":"2026-09-29T20:45:31","slug":"openai-sued-over-the-hugging-face-hack","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=7861","title":{"rendered":"OpenAI Gets Sued Over the Hugging Face Hack"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">A legal nonprofit<\/span> sued <a href=\"https:\/\/www.wired.com\/tag\/openai\/\" class=\"text link\">OpenAI<\/a> in a California court on Tuesday over the company\u2019s agents escaping a testing environment and <a href=\"https:\/\/www.wired.com\/story\/openai-models-escaped-containment-and-hacked-huggingface\/\" class=\"text link\">hacking the open source AI platform Hugging Face<\/a>. \u201cOpenAI\u2019s actions straightforwardly violated California law,\u201d the suit alleges.<\/p>\n<p class=\"paywall\">The <a data-offer-url=\"http:\/\/lasst.org\/in-the-courts\/hugging-face-complaint\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;http:\/\/lasst.org\/in-the-courts\/hugging-face-complaint&quot;}\" href=\"http:\/\/lasst.org\/in-the-courts\/hugging-face-complaint\" rel=\"nofollow noopener\" target=\"_blank\">suit<\/a> was filed by Legal Advocates for Safe Science and Technology (LASST) and the law firm Gerstein Harrow in California Superior Court in San Francisco, where OpenAI is headquartered. It alleges that OpenAI\u2019s agents violated California\u2019s Comprehensive Computer Data Access and Fraud Act (CDAFA) by breaching Hugging Face over the summer. The suit, which comes amid <a href=\"https:\/\/www.wired.com\/story\/openais-rogue-ai-agent-hacked-more-than-just-hugging-face\/\" class=\"text link\">ongoing disclosures<\/a> <a href=\"https:\/\/www.wired.com\/story\/ok-well-there-are-even-more-ai-agent-hacking-incidents\/\" class=\"text link\">across the industry<\/a> of agents going rogue, claims that OpenAI should be held responsible for the activity given <a href=\"https:\/\/law.justia.com\/codes\/california\/code-civ\/division-3\/part-3\/section-1714-46\/\" class=\"text link\">a California AI law<\/a> in effect since January 1 that says \u201cit shall not be a defense \u2026 that the artificial intelligence autonomously caused the harm to the plaintiff.\u201d<\/p>\n<p class=\"paywall\">\u201cWe think it\u2019s extremely important that existing laws are enforced to hold AI companies accountable for the harm they\u2019re causing,\u201d Tyler Whitmer, founder of LASST, tells WIRED. \u201cEspecially when that harm is caused by autonomous agents, because we see that as an obvious, extremely risky thing in the world that\u2019s very new.\u201d<\/p>\n<p class=\"paywall\">OpenAI did not immediately respond to a request for comment.<\/p>\n<p class=\"paywall\">On Monday, Florida attorney general James Uthmeier <a data-offer-url=\"https:\/\/www.myfloridalegal.com\/newsrelease\/attorney-general-james-uthmeier-files-temporary-injunction-against-openai-and-its-ceo\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.myfloridalegal.com\/newsrelease\/attorney-general-james-uthmeier-files-temporary-injunction-against-openai-and-its-ceo&quot;}\" href=\"https:\/\/www.myfloridalegal.com\/newsrelease\/attorney-general-james-uthmeier-files-temporary-injunction-against-openai-and-its-ceo\" rel=\"nofollow noopener\" target=\"_blank\">filed<\/a> for a temporary injunction against OpenAI to block development of models without independent oversight, amid a lawsuit Florida brought in June against OpenAI and its CEO, Sam Altman. OpenAI \u201casked the government to tie them to the mast. Well, Florida is answering their cries for help,\u201d Uthmeier <a data-offer-url=\"https:\/\/x.com\/AGJamesUthmeier\/status\/2104565019597848938\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/AGJamesUthmeier\/status\/2104565019597848938&quot;}\" href=\"https:\/\/x.com\/AGJamesUthmeier\/status\/2104565019597848938\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> in a statement.<\/p>\n<p class=\"paywall\">Given that <a href=\"https:\/\/www.wired.com\/story\/ai-agents-are-about-to-flood-the-workforce-no-ones-ready-for-it\/\" class=\"text link\">the whole point of AI agents<\/a> is that they can be empowered to take actions on a (human) user\u2019s behalf, AI developers and safety researchers have long foreseen that unintended \u201cagentic\u201d activity would be a concern as machine learning development progressed. Protections built into mainstream, consumer AI systems have largely prevented mass rogue activity so far, but rapidly advancing capabilities in general, as well as situations where guardrails are suspended (such as in the Hugging Face case where OpenAI had removed some model restraints for testing), have led to an apparent uptick in rogue agent activity.<\/p>\n<p class=\"paywall\">As governments <a href=\"https:\/\/www.wired.com\/story\/washington-wont-be-regulating-ai-anytime-soon\/\" class=\"text link\">weigh AI regulation<\/a> amid both <a href=\"https:\/\/www.wired.com\/story\/why-so-many-ai-researchers-think-the-machines-could-kill-everyone\/\" class=\"text link\">existential safety questions<\/a> and economic and national security considerations, researchers and people around the world have increasingly called for accountability mechanisms for AI. And from a <a href=\"https:\/\/www.wired.com\/story\/openai-anthropic-ai-hacking-sprees-illegal\/\" class=\"text link\">legal perspective<\/a>, experts have largely emphasized that questions of responsibility, liability, and culpability can only be answered through precedent set by cases working their way through courts.<\/p>\n<p class=\"paywall\">\u201cAfter the Hugging Face incident was disclosed, we actually did a bunch of work trying to educate regulators and civil society organizations about the hack. And we were kind of wondering, is anyone going to do anything about this in court?\u201d Whitmer says. \u201cThere are structural reasons why we think Hugging Face, which is the obvious potential plaintiff to do something here, is not doing anything. So given that it didn\u2019t seem like anyone else was going to do anything about this, we moved forward.
