{"id":8373,"date":"2026-10-08T19:19:29","date_gmt":"2026-10-08T19:19:29","guid":{"rendered":"https:\/\/silvybrand.com\/?p=8373"},"modified":"2026-10-08T19:19:29","modified_gmt":"2026-10-08T19:19:29","slug":"trump-administration-crackdown-microsoft-adobe-immigration","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=8373","title":{"rendered":"Trump Administration Cuts Off Access to a Major Immigration Program for Workers at Microsoft and Adobe"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">The Trump administration<\/span> will no longer allow <a href=\"https:\/\/www.wired.com\/tag\/microsoft\/\" class=\"text link\">Microsoft<\/a> and other tech companies to participate in a program that allows <a href=\"https:\/\/www.wired.com\/story\/made-in-china-a-new-game-turns-the-h-1b-visa-system-into-a-surreal-simulation\/\" class=\"text link\">H-1B visa holders<\/a> to apply for green cards, one of the most common pathways for skilled foreign workers seeking permanent residency in the United States.<\/p>\n<p class=\"paywall\">In addition to Microsoft, administration officials said on Thursday that software giant Adobe and IT companies including Cognizant, Infosys, and Tata will be suspended from the PERM program, the Labor Department&#8217;s permanent labor certification program. PERM is a key step for H-1B visaholders to gain permanent residency, requiring employers <a href=\"https:\/\/flag.dol.gov\/programs\/perm\" class=\"text link\">to prove that there are no American workers<\/a> who would be suitable for the applicant&#8217;s permanent job opportunity.<\/p>\n<p class=\"paywall\">Secretary of Labor Keith Sonderling said that the agency is investigating whether these companies committed fraud, undercutting American workers by hiring foreign employees.<\/p>\n<p class=\"paywall\">Vice President JD Vance, meanwhile, singled out Microsoft. &#8220;There has been no company in the United States, unfortunately, that has abused this system more than Microsoft,&#8221; Vance <a data-offer-url=\"https:\/\/x.com\/atrupar\/status\/2108209099070472487\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/x.com\/atrupar\/status\/2108209099070472487&quot;}\" href=\"https:\/\/x.com\/atrupar\/status\/2108209099070472487\" rel=\"nofollow noopener\" target=\"_blank\">said in a press conference.<\/a><\/p>\n<p class=\"paywall\">In a statement provided by Microsoft representative Kaitlin Haskins, the company said it \u201conly files H-1B petitions for those who meet the rigorous standards of this visa category,&#8221; adding that it develops its workforce by &#8220;strengthening this country\u2019s talent pipeline, hiring American workers, and attracting the best talent from around the world.&#8221;<\/p>\n<p class=\"paywall\">Adobe, Cognizant, Infosys, and Tata did not immediately respond to WIRED&#8217;s request for comment.<\/p>\n<p class=\"paywall\">The suspension marks a victory for tech workers who have complained about unfairly losing out on jobs to immigrant workers.<\/p>\n<p class=\"paywall\">Jobs Now, an advocacy group composed of US citizens working in big tech, celebrated Vance\u2019s announcement on its X account with a video of dancing crabs. The group publicizes otherwise difficult-to-find PERM job postings and says it helped Americans apply to nearly 500,000 jobs across 7,000 employers between last January and this past July.<\/p>\n<p class=\"paywall\">The organization and its members have also filed complaints against tech companies about alleged abuse of the PERM system, and have called for <a data-offer-url=\"https:\/\/www.jobs.now\/blog\/proposal-to-protect-skilled-american-workers-through-visa-reform\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.jobs.now\/blog\/proposal-to-protect-skilled-american-workers-through-visa-reform&quot;}\" href=\"https:\/\/www.jobs.now\/blog\/proposal-to-protect-skilled-american-workers-through-visa-reform\" rel=\"nofollow noopener\" target=\"_blank\">a number of changes<\/a> to the employment immigration system. \u201cEvery job in America should be offered to an American first, no exceptions,\u201d the group told WIRED in an unsigned statement.<\/p>\n<p class=\"paywall\">This isn&#8217;t the first time tech companies have been targeted over PERM. Earlier this year, OpenAI and a company it acquired agreed to settle accusations from the Trump administration about violating rules for the program.
