The lawsuits, filed separately by Iowa, Kansas, Nebraska, West Virginia, Arkansas, Arizona, Idaho, and Montana, allege OpenAI unlawfully put profits over safety when developing ChatGPT.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">The string of complaints claims that OpenAI violated local consumer protection laws by failing to warn customers about the dangers of ChatGPT, citing several lawsuits filed <a href=\"https:\/\/www.theverge.com\/ai-artificial-intelligence\/928691\/openai-chatgpt-wrongful-death-overdose\">by the family members<\/a> <a href=\"https:\/\/www.theverge.com\/news\/831207\/openai-chatgpt-lawsuit-parental-controls-tos\">of teens and<\/a> <a href=\"https:\/\/www.theverge.com\/news\/842494\/openai-chatgpt-wrongful-death-suzanne-adams-delusions\">adults<\/a> that allege the AI chatbot played a role in their loved ones\u2019 deaths. They allege that while OpenAI misleadingly presented ChatGPT as a \u201csafe, youth-appropriate tool that puts safety first,\u201d it was actually \u201cdangerous to vulnerable users\u201d \u2014 including by \u201cdegrading critical thinking skills, encouraging paranoias and delusions, offering dangerous medical advice, and promoting unhealthy behaviors and relationships.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">Additionally, the states accuse OpenAI of collecting data from minors and not doing enough to keep underage users from using the chatbot. The lawsuits also cite <a href=\"https:\/\/www.theverge.com\/ai-artificial-intelligence\/985385\/openais-rogue-ai-model-hugging-face-cybersecurity-incident-reports-metr\">recent rogue AI hacking incidents<\/a> as evidence of OpenAI\u2019s alleged \u201crecklessness.\u201d<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">\u201cOpenAI has devolved from its original mission as a public-first nonprofit that prioritized safety into a cautionary tale about what can happen when the development of a tool as powerful as AI is driven not by safety, but by a profit\u2011at\u2011all\u2011costs mindset that sidelines essential safeguards,\u201d <a href=\"https:\/\/www.documentcloud.org\/documents\/28813407-arizona-v-openai\/\">Arizona\u2019s lawsuit claims<\/a>.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">In an emailed statement to <em>The Verge<\/em>, OpenAI spokesperson Drew Pusateri says the company has \u201cbuilt industry-leading age-specific protections\u201d into ChatGPT:<\/p>\n<\/div>\n<div>\n<blockquote class=\"duet--article--blockquote _1lkuyz82 _1lkuyz80 _19wv7tc9\">\n<p class=\"duet--article--dangerously-set-cms-markup _1lkuyz89 _1lkuyz88 _19wv7tc1\">While no system can be perfect, we\u2019ll continue to work with experts to inform our work and build additional safeguards, such as the parental controls, break reminders and age-appropriate model protections that exist today. We\u2019re committed to working with states on advancing pragmatic AI policies that apply to the entire AI industry &#8211; not just one company.<\/p>\n<\/blockquote>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">The states are asking the courts to force OpenAI to pay a series of civil penalties and to stop misleading the public about the safety of ChatGPT.
