{"id":9367,"date":"2026-10-26T14:28:44","date_gmt":"2026-10-26T14:28:44","guid":{"rendered":"https:\/\/silvybrand.com\/?p=9367"},"modified":"2026-10-26T14:28:44","modified_gmt":"2026-10-26T14:28:44","slug":"the-us-government-is-hiding-a-secret-court-ruling-about-how-it-spies-on-americans","status":"publish","type":"post","link":"https:\/\/silvybrand.com\/?p=9367","title":{"rendered":"The US Government Is Hiding a Secret Court Ruling About How It Spies on Americans"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p><span class=\"lead-in-text-callout\">Two Democratic senators<\/span> who have long overseen <a href=\"https:\/\/www.wired.com\/story\/the-fbi-doubles-down-on-easing-bestiality-hiring-standards\/\" class=\"text link\">US intelligence<\/a> say the Trump administration is illegally withholding a secret court\u2019s findings from Congress until lawmakers renew a program that lets federal agents read Americans\u2019 communications without a warrant.<\/p>\n<p class=\"paywall\">Seven months ago, the Foreign Intelligence Surveillance Court objected to search filters that let intelligence analysts pull Americans\u2019 messages from intercepted data without the approvals, written justifications, or records the law requires. The court approved another year of surveillance anyway. The ruling has never been made public, and Senators Ron Wyden of Oregon and Adam Schiff of California say the administration\u2019s own deadline for releasing it passed in September.<\/p>\n<p class=\"paywall\">The program, Section 702 of the Foreign Intelligence Surveillance Act (FISA), lapsed in June after Congress failed to renew it, though collection continues under the court\u2019s March approval. The administration\u2019s <a data-offer-url=\"https:\/\/www.intelligence.gov\/assets\/documents\/702-documents\/702_Post_RISAA-FINAL.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.intelligence.gov\/assets\/documents\/702-documents\/702_Post_RISAA-FINAL.pdf&quot;}\" href=\"https:\/\/www.intelligence.gov\/assets\/documents\/702-documents\/702_Post_RISAA-FINAL.pdf\" rel=\"nofollow noopener\" target=\"_blank\">own public documentation<\/a> says rulings like this one are reviewed for public release \u201cwithin 180 days of issuance.\u201d That window closed September 13, even as intelligence officials press lawmakers to reauthorize the program by the end of the year.<\/p>\n<p class=\"paywall\">Wyden, the longest-serving member of the Senate Intelligence Committee, and Schiff, the former chair of its House counterpart, say the administration owes Congress an explanation for the delay, and the names of the officials responsible, by November 6.<\/p>\n<p class=\"paywall\">\u201cIf this administration won\u2019t follow this simple statutory directive,\u201d the senators told Director of National Intelligence Jay Clayton and Attorney General Todd Blanche in a <a data-offer-url=\"https:\/\/www.documentcloud.org\/documents\/28833648-2026-10-26-letter-from-senators-wyden-and-schiff-to-dni-clayton-and-ag-blanche\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.documentcloud.org\/documents\/28833648-2026-10-26-letter-from-senators-wyden-and-schiff-to-dni-clayton-and-ag-blanche\/&quot;}\" href=\"https:\/\/www.documentcloud.org\/documents\/28833648-2026-10-26-letter-from-senators-wyden-and-schiff-to-dni-clayton-and-ag-blanche\/\" rel=\"nofollow noopener\" target=\"_blank\">demand letter obtained exclusively by WIRED<\/a>, \u201cit is unclear why Congress or the American people should trust this administration to follow any of the other legal limits to Section 702.\u201d<\/p>\n<p class=\"paywall\">Outside Congress, Demand Progress and 22 other civil liberties and government accountability groups on Monday <a data-offer-url=\"https:\/\/www.demandprogress.org\/api\/media\/file\/FISCDeadline.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.demandprogress.org\/api\/media\/file\/FISCDeadline.pdf&quot;}\" href=\"https:\/\/www.demandprogress.org\/api\/media\/file\/FISCDeadline.pdf\" rel=\"nofollow noopener\" target=\"_blank\">urged congressional leaders to refuse to reauthorize Section 702<\/a> \u201cwhile the administration actively withholds legally mandated information about how the surveillance program operates.\u201d Signatories range from the American Civil Liberties Union to the conservative-backed Project for Privacy and Surveillance Accountability.<\/p>\n<p class=\"paywall\">The Trump administration has already been pressed, and has promised, to release the ruling. In April, senators Tom Cotton and Mark Warner, the Intelligence Committee\u2019s Republican chair and Democratic vice chair, <a href=\"https:\/\/www.congress.gov\/119\/crec\/2026\/04\/30\/172\/76\/CREC-2026-04-30-pt1-PgS2158-2.pdf\" class=\"text link\">pressed the administration<\/a> to release it within 15 days so it could inform the Senate\u2019s debate. In July, <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/98781d53-bdcc-75d8-c507-1b1bca492142\/2026-07-15_QFR-Responses_Blanche_687007f1-363d-40d9-b7da-356b52dc448d.pdf\" class=\"text link\">asked in writing<\/a> whether he would commit to declassifying it by the 180-day deadline, Blanche replied, \u201cYes.\u201d<\/p>\n<p class=\"paywall\">Warner \u201chas been clear that he supports transparency with regard to Section 702,\u201d his communications director, Rachel Cohen, tells WIRED.
